I worked in a call centre full time with an employment contract which states I need to give one months notice to leave my employment, I put a letter of one months notice in on friday as I start a new job at the begining of april, my employer said they accept my resignation but have stated that this is immediate! Im now without a wage for April, what is my next step?, a letter to hr stating they must pay me in my notice period, as this is part of the contract I was upholding my end of the deal giving my notice, they have terminated my contract immediately! Can someone help, many thanks Additional Details I worked for the company for four and a half months, it sts in their contact after one months service, I need to give one months notice.

If your contract stated that it was a months notice and you gave this, then they must pay you for the month even if they want you to leave immediately.
They can only get out of it if they say you have been sacked but then you would have a case for wrongful dismissal etc.

If you have given correct notice and you are available to work during the notice period then you are entitled to be paid at your usual rate throughout the notice period.
If your employer does not allow you to satisfy the terms of your contract then they are clearly in breach of said contract and you are in a god position to sue re: breach of contract and seek remedy at a Employment Tribunal (ET) re: unfair deduction from wages.
In the first instance, write to your employer stating that their actions appear to be a clear breach of contract and that their refusal to pay you during your notice period amounts to a unfair deduction from wages. State that you require payment as usual at the end of your notice period or you will seek further advice and take appropriate action without further notice.

Write to your HR department and keep a copy of the letter state that you kept your side of the contract by giving one months notice and expect to be paid as you were quite prepared to wok that months notice. Inform them that you expect the money to be paid into your account on pay day as normal and if you do not receive it that you will be left with no other option than to seek further advice due to breech of contract.
acas won't assist as you have no employment rights until you have been with the company a year however you could contact your local court and seek payment through the small claims court. This is probably the only way you would be able to get the money they owe you but check the small print on your contract first to ensure there is nothing written in there regarding probationary periods. |

I am pretty sure that they need to pay you, as their contract states that you must give a months notice. Although they can ask you to leave straight away (they do that in my company because it is sales based and we dont want an emplyer moving to a competitor and stealing clients) but we still pay them for the notice and they are allowed by law to keep the company car until the person has officially left the company.

Under 12 months they can do what they want and some companies do that if you have been with them for 10 years, you will get they wages you worked, you wont have any holiday pay as you have to work in a Company for 14 weeks before holidays are built up, legally you are unemployed but it takes about 3 weeks for the job centre work out any money you may get and you can apply for a crisis loan you pay back. Call Centres are like that because they always have someone to fill your job tomorrow. The company I was with for 5 years ceased trading in January and it took over 3 weeks before my benefits were paid, I was unemployed until 2 weeks ago when I had to sign off for starting a new job, my benefits stopped instantly and i have had no money until I get paid on the 27th March - I have borrowed from family, I asked them for a crisis loan until I got paid but it was too complicated, years ago they gave you benefit till you got your first wage but now for a loan they contact the company, the company gives you the loan the job centre then pays them and company deducts it from your wage. Thankfully my rent gets paid for a month after signing off. |

If you have not long started at the call centre then you may still be under a probation period which means that the company are perfectly wihtin their right to dismiss you without any further reasons. However, these normally only last about 4-6 weeks and after that you have the same rights as any one else who works there. Report these people to your local citizens advice bureau and you may find yourself coming into a bit of money if you have the right team on your side! good luck |
