Employment and criminal conviction?
Find answers to your legal question.

Employment and criminal conviction?

I have a friend who has a minor criminal conviction. According to him the conviction falls under an alias, not his legal birth name. The question he asked me which I don't know is, If he use his legal name in order to obtain employment, will his minor criminal conviction show up? I told him that a job application is a legal document and advised him not to lie, however do to his stubbornness he asked me to post the question for him. Again when he was arrested he use a different name then the one he has on his birth certificate. Keep in mind he is desperate for work and because he has been up front with potential employers about his conviction he has been experiencing a lot of rejection.

Usually when we do a criminal check we ask for all alias, and the check that we do would bring it up anyway. If he lies it will hurt that much worse, but if he's up against someone with a clean criminal record the other person will get the job.

What do you consider a "minor conviction"? That matters to the answer.

I know how he feels. I got a DUI about 6 years ago and it still haunts me on my job applications. The best thing your friend can do is be honest. I know how hard it can be, but if he can be honest and show the prospective employer that he is the real deal, I'm sure that he can make some headway.

When filling out a job application, you have the right not to disclose any information. Although you risk being let go if they find out later. It is also the employers right to do a background check or criminal conviction check if they choose to do so. When you are arrested under an alias, that alias will show up under your real name on criminal record checks. In my case, I have a record longer than most peoples arms. I have been free and clear for 5 years now and on most applications I put down "no" unless for example, I know that there will be a record check, then when I go to the police station, I have the right to disclose "all" the details of my record or I can disclose that "yes, this person may have a record". All of my truck driving employers have taken it at face value when I tell them that yes I have a criminal record and they get a copy from the police saying that yes I in fact have a record. Never have I been asked to get a copy from the police asking for the "specific" information, nor have employers ever pressed me for details. They will just not send me to the U.S. I also do not apply for jobs that are above my ability to be hired for, such as Armoured Money Cars, Security, work, etc. Hope this helps.
