Employment disciplinary?

At a hearing with my employer today I placed my phone in front of me and told him he would be recorded. He told me no way, but he is a liar and I only want this record because I already know I cannot trust him. Can I record employers meetings?

No you cannot record the meeting in this way. What you do have the right to is a witness ( as does your boss) and a copy of meeting notes and any evidence/ notes to be used in the hearing. You can also speak to your HR department for advice or contact ACAS who will give impartial advice.

OK, I am not a lawyer...however, I know about employment law, as I am a manager of a global company.
When you attend an employment disciplinary, firstly, you are entitled to representation. That is either a Union Rep or a friend of your choice who note-takes the conversation. (For your protection: if your employer cannot be trusted then a rep is as good as a recording.)
You are not automatically/legally entitled to record a conversation if the other party objects. The employer also invites a note-taker to record the conversation officially.
If your manager/employer is a liar, then he will either be found out for his lies, or will have to toe the official line in your meeting when you have your own representation.
Do this, and hopefully you will be treated fairly. I wish you all the luck.

I am not sure about that however, you are able to appoint another member of staff to be with you at the meeting to take notes (as you can yourself). I would certainly ensure that you take someone in with you. I have been in a similar situation and believe, me you need to record everything that happens to cover yourself. If not, just take your mobile in with you in your pocket on record function. Make notes during the meeting - just so he knows exactly that you are in control.

In an emloyment disciplinary, there are at least three people. Yourself, the person conducting the meeting, and a note-taker.

The note-taker should remain impartial and only document what has been said.

You also have the right to take into the meeting an union representitve.

The union representitive is there to make sure that the meeting is conducted correctly.

If your meeting isn't being run as described above, then it should be against company regulations.

So to answer your question, if the meeting is being run correctly, there will be no need to record your employer at the meeting.

Unfortunatley, some of these employers think they are above the law in the way they act.
The truth is that you can not tape a conversation without their agreement. If you do so, then you will find that in a court of law it will not be admissible.
However, if you taped it without their knowledge and did a copy of it, you could then send them the copy and say why you did it.
As long as you don't publish it I think you will be safe. I say this because if they go back on what they say, they are not really going to want be found out are they.

No, you can not record the hearing but you can have a union rep or a colleague there to support you
