I apologize for the length but I need to give a lot of detail to get the help I need. I have been a portrait studio manager for 10 years, recently I changed jobs, I was offered and accepted an assistant manager position with the understanding that I would get a manager's position when one came available, the first day I started I was informed that I would not be an assistant manager yet??? the 'manager' was a 24 year old girl that has only been a manager for 2 months, I could tell right off she was intimidated by my experience, she wouldn't teach me anything or let me do anything, I taught myself what I needed to know, I went to work everyday on time and my work was exceptional, customers loved me, to make a long story short, she called me this morning, 2 hours before my shift and told me that she new I wanted a manager's position and since she didn't have one available she didn't want me to come back, in other words, she fired me for no reason. she had been lying to her boss about me so when she called this morning I asked my husband to listen, so he was a witness to the conversation. what can I do about this, I know I can get unemployment but do I have a lawsuit or will the labor board help with anything? I have the job offer that I never got in writing

I wasn't at the same place for 10 years, I have 10 years total management experience. I am in NC

If this is a larger company, I would contact their home office HR department first thing and ask for the highest HR executive, probably a VP. If it is a local business I would contact the highest ranking executive that I could find. If you have the job offer in writing that is a lot of evidence. Beyond that, you have two ways to proceed, First, you may want to contact an attorney who has knowledge of employment law in your state. I'm not a lawyer, but you have suffered damages by quitting a job where you had 10 years experience for a position that didn't exist. You may be entitled to compensation beyond UC. Second, call the appropriate office in your state - labor department, maybe even the state attorney general, and ask to talk to someone about your situation.

yes, you have a good case. You may be able to file suit in federal court, but, that has to be determined by EEOC. So, go to EEOC and file your compliant, your statue of limitations is 6 months to file with them. If they determine you have a case then you will receive a right to sue letter from them. However, if they determine that you cannot file a claim with them. Then there is small claims court, you will be limited to the maximum for your state. The fact that you left your job of 10 years for the promise of opportunity with another company and then terminated because she lacks your experience is more than enough.
