Employment law - advice required for my mother?

My mother is employed by a very large family run high street department store and has been for the last 21 years. She was supposed to retire at 65 but has been working on a one year rolling contract for the last year. Yesterday she was told that after April she is no longer required - this is due to the credit crunch, although the store has had some excellent results recently.
Is there anyway that she can appeal against this dissmisal?

The first answer is correct - it sounds like redundancy. Employers wouldn't cite reasons like "the credit crunch" if it wasn't about finances.
You can always appeal against redundancy but majority of the time it is not worth doing. The company needs to let people go, most companies do select staff fairly, and provided they comply with the law regarding the actual redundancy procedure, then they're within their rights to make people redundant. The fact is, no-one wants to lose their job, especially not at the moment, but companies have got to let some people go to reduce their costs - and especially in fields like retail where no-one is spending any money.
You can contact ACAS for further information but I think you'll find that this is not worth pursuing. |

I don`t think you can class it as a dismissal as she hasn`t been sacked as such, she has had another 12 months work which they didn`t have to give her, some 65 yr olds are a healthier than others and want to continue working but they should think about young people who are out of work and need money for mortgages and family, your mother will have a pension and if she is still sprightly why doesn`t she do some charity work or part time cleaning for some extra money. |

No - its only fair that someone who is past retirement age is amongst the first to go in hard times. She isn't being dismissed she is retiring. And you have no way of knowing what their trading is like at all. They would not be letting people go if they were doing even just OK. |

This appears to be redundancy, rather than dismissal.
