The company I work for is currently in administration. My contract is as an administration assistant but while in administration the editor left and I was told that I was editor and would be doing his jobs but due to the administration there was no written conformation. Now the company is looking to come out of administration and the new owners have said I will be going back to being an assistant dispite me doing the editors job with no problems on the same money as the assistants job and working extra hours. Are they legally allowed to do this?

As there was no contract or no written proof, then unfortunatly yes they are.
If yu were not getting extra money and working more hours, effectively you have been giving your time to your employers for nothing, rather you than me. |

Yes, of course they're allowed to do it.
If your company is bought out by another one, they have two choices over how to deal with you, with one choice being that they employ you under exactly the same terms as what you are currently contracted under (the other option is redundancy). That's what they're doing, so they're well within the law.
When you moved into the other position, you should have asked to be issued with an amended contract. As you didn't, your contract still states your original terms of employment and therefore this is what stands. |

apparently you were asked to step into a job on a temporary basis - when this happened you should have asked your employer that if you were able to demonstrate that you could perform the job function would you then be compensated accordingly - and would you have the opportunity to have the job on a permanent basis -
the short side of it is - if they want to put someone else in the position they can do it anytime they want and you have no recourse - its their business, and they can hire and fire "at will" and that also means they can promote and demote people "at will" -
it doesn't mean that its a good way to create harmony in the work force or make people enthusiastic about who they're working for and doing a good job for them (going the extra mile so to speak) - but they can do it |

not legally. i watch law and order every day. you cannot legally take a persons will from the companies position and place it beneath or above for the same contract and or paycheck. wow i cant believe i remembered that. |
