Employment rights *Help Required*?

Is there some guidelines that anyone knows of on the comparrison of a 'permanant employees' right to that of people on 'fixed term contracts'. I have seen the ones on 'fixed term contracts' being treated as fairly as permanant ones, but in my case the situaution is in reverse. I am a permanant employee who is getting the bad side of the deal. Do i have the same entitlement to my salary as them when we have the same job title and do the same job?

The first Answerer is correct in that after two years' employment, temporary staff have the same rights as permanent staff but before that they not.

Now, it is NORMAL that permanent staff get paid less than temporary workers. Why? Because temporary workers only get their salary, and if they don't work they don't get paid. You get sick leave, you probably get benefits like a pension scheme and perhaps other things such as health insurance and childcare vouchers and paid study. You also have the security in that temporary workers can be dismissed at any time, whilst you obviously have protection under law that this cannot happen.

So, you say you are getting the bad side but you're not taking all factors into account. Have another look at the whole picture.

Aside from that, unless you are in a union or something, then almost everyone negotiates their salary individually and many people do the same job for different pay. It will depend on all sorts of different factors from how long you've been there, how good you are, and most importantly, how good a negotiator you are!

of course you do unless they are more qualified than you for example you are earning 500 pounds a week as say an ict consultant and your friend had the same job but he had 1 a-level in it that you don't have he might make 550 pounds a week

If in the UK, a worker starts to automatically gain Employee status after 2 years service. Up till then, I am afraid you are a worker and do not have the same rights as a company Employee. Companies do this a lot and its a way of protecting themselves from Redundancy.

A recent change in the law stipulates that both temporary and permanent staff in the same position should be treated equally. This relates to duties, holiday entitlement, salary. You don't have to have been there for 2 years!

If you just look at the hourly rate, then you probably are getting the raw deal.

However, when you factor in all the other 'advantages' of being permanent, not least of which is the stability that you'll have, you would probably find equal treatment.
