Hi,

This a UK employment law question…..

Does a UK employer have a legal obligation to provide transport home for staff from, for example, a Christmas party which is held away from work property, not in work time, and is where attendance is voluntary?

simple answer No it is your responsibility in fact the law has changed so that companies do not have to provide parking area for there employees

No, you answered your own question, attendance is voluntary.

If it was compulsary attendance then yes.

If it was in work time and compulsary then yes.

If in work time but not compulsary then no.

They don't have to specifically arrange transport to take the staff home, however the employer does some duty of care.

Q. What if an employee who has clearly drunk too much at the office Christmas party is planning to drive home. It's not my responsibility, is it?

A. In fact, it is. As an employer you have a 'duty of care' toward your employees and as it's the company's party, you need to take some responsibility. Think about travel arrangements and maybe end the party before public transport stops running. Or provide the phone numbers for local registered cab companies and encourage employees to use them. Hiring minibuses to take staff home is another option which would probably be greatly appreciated.

On looking at your problem on the outset, I would expect so and it may be that the company can reimburse you for your travel expenses or you could get a lift from a work colleague but this is not definite...

Is there anything in your contract on this point? This is a good place to look. If you do not have a written contract, your employer is obliged to provide you with the terms of your employment.

Have you tried addressing your concern with your employer? You never know, they may be in the best position to answer your question.

in the u.s. i would say no, but in the u.k. i would say probably so, but then being a company with a celebration associated with the company, i would think it good business sense and good people relations to offer transportation to those who would otherwise be at risk of intoxicated driving, which could not only in-danger the driver and other drivers on the road, but also could somewhat slightly damage reputation of company should an accident occur. it might make you look bad - unless you're company is not very lucrative monetarily and then people would understand?
