Ex-employer has broken into my email, is this legal?

Hi,
I was made redundant at the end of November and I have know that my ex employer has gained access to my yahoo account on several occasions. I was given no notice and had to leave on the day I was told of my redundancy. A colleague told me the following day that my ex employer had been looking at my personal Yahoo account. I have to say that the password was not very secure and that they easily could have worked it out. I quickly changed the password there and then. A few weeks later I was locked out of my yahoo account and I had to re set the password. I have since been told that my ex employer had gone in and messed around with it. They have read all my personal emails and have been threatening customers and suppliers of mine. I am in the process of setting up on my own. There was nothing in my contract to say that I could not contact suppliers and customers. He had also agreed to the fact that he would not hinder me in any way in any new employment.
I have emailed Yahoo 3 times now requesting IP addresses of the computers that have accesses my Yahoo account but they have yet to go back to me.
I have also been to the Police but they want to wait until I have had some more info back from Yahoo. This has been going on for nearly a week now and I would really like some answers.

I have just read the computer mis use act and it had details of employees gaining access to unautherised emails etc within a company but not the other way around.
I did not send any of the emails until I had left that companies employment.
There was no IT policy at my old work
I have been asked Yahoo for IP addresses but they are being slow in giving me anything but an auto response.

Yes, that is illegal if it was your personal yahoo account.
If it was your company e-mail at your ex company then that is ok.

You need to chase Yahoo and the police on this one.

Sorry I cannot provide you with much guidance on the intricacies of UK law in this area (I'm assuming you are in the UK based on the law you cited) but to be blunt, neither can anyone else who has posted here. The laws on privacy, electronic mail and employer access are complex in the United States and may be as complex in the UK. You wont really know all of your options unless and until you engage a lawyer to advise you.

Your lawyer will probably advise you of the possibiltity of a counterclaim by your employer for violation of a non-competition clause in either your contract or one of its company policies or employee manual. You say that your contract had no non-competition clauses but it's an understatement to say it would be unusual for an employer to not have a non-compete clause in place for an employee that works with its suppliers and customers. Your former employer's contacts with its suppliers and customers regarding you seems to support the likelihood that there is a non-competition policy in place of which you may not be aware but which is enforecable against you. As this is your livelihood, it is yet another reason you need to bring a lawyer into this sooner rather than later to consider your options.

Last, you need to find out from Yahoo what is going on with your email account and what role it played in your employer's access to your email account. It may have been compelled by legal action from your employer to give access to the email account. Again, this is where having a lawyer contacting Yahoo may expedite matters.

That's bang out of order, yeah it's illegal. Just because he's your ex boss it doesn't give him any rights at all to something like that.

Continue to contact Yahoo over this and go above your ex bosses head, he'll have a boss to... report him.

DEFINATELY illegal you should contact the email provider and explain the situation and hopefully they will be able to solve the matter in hand and find out where things went topsy turvy :)

You dont need to wait for the yahoo people to reply you. Just lodge a complain under Cyber crime act it depends on your country. The best thing is to contact a lawyer to get legal advise.
