Can someone who understands the ins/outs of unemployment compensation please help me. I was laid off after 7 years of steady employment in FL with a construction firm in Jan 2008. I collected on my initial claim for approx 6 months until the total available under FL law was paid out - then in the fall of 2008 I found a job at a company which lasted 2 months & unfortunately I was dismissed from for not meeting performance criteria (I was unable to perform some aspects of the job properly due to lack of experience). I had heard that the President (Bush) had passed an "extension of unemployment benefits" in late 2008 which I believe was an additional 13 weeks. So I applied for the extension of unemployment, which would be an addendum or re-opening of my original unemployment claim, adding the 13 weeks onto it. Initially FL unemployment approved the extension and granted me unemployment payments (this was about a month ago) - then I suddenly got a letter in the mail saying my claim was being denied now because of that last employer (the one I had in Oct/Nov of 2008) told unemployment that I was terminated with cause.
I am really confused here. Even if I was as the employer said "fired with cause" - why would that deny or rescind any extension to my ORIGINAL unemployment claim - the Original claim was based on my work and income for the prior 7 years of full time work at the construction firm. How or why would a job I just recently worked for only 2 months negate or cancel my entire unemployment extension on that previous unemployment claim ? I guess they are trying to include any "additional" income I had for 2008, after the initial unemployment claim ran out, which I understand. But denying me the extension of the original u/c claim because of being let go by another later employer - this I just don't understand. Isn't the 13 week extension based on the money I paid into the u/c system in the prior 7 years of full time work. I am really confused on this denial. Thanks for any help someone can give me that knows something about unemployment law and the 13 week federal extension passed in 2008.

Employers pay into Unemployment Insurance so the Employee continues getting a paycheck even after they are laid off/fired.
Once You started working(no longer unemployed) Your right to Unemployment Compensation from you old employer ended. |
