If your employer is an "at-will" employer then they can let you go with or without notice. Check your employee handbook or other documents they have given you about the company and see if that is mentioned. Another thing to consider is were you still in an introductory period with the company? Some companies will have people on probation (they call it introductory period) with the company anywhere from 90 days to 6 months. My second question to you is who said you were doing a good job? Was it your boss? The owner of the company?
Can you sue, sure, you can try to do that. Your first step is to file a claim with the E.E.O.C. (Equal Employment Opportunity Commission) for wrongful termination. You will need to give them some information to support your claims, like the date and time of the conference call you mention and any other evidence you have regarding your allegations of racism. Were there other comments made about race that you heard? It will take the commission about 6 months or maybe a little bit longer to investigate the claim, both you and the employer have the right to appeal the decision two times. Then they will either dismiss your claim or give you a right to sue letter. You would take that letter to an attorney and then you can file a civil suit against the company. The whole process could take up to 2 years or longer before you will get to the deposition stage, which could go another 3 - 5 months. All told it could be about 3 - 4 years before you get to court (if it goes that far). |

Some states will permit an employer to terminate an employee "at will" with little or no reason. If that's the case in your state, the only recourse you might have could be if you can somehow show convincing evidence of the breaking of a law, such as discrimination, ... but I'm no lawyer. You might try to find out if other former employees have been fired based on race, I suppose. |

With an at-will employment and no contracts or union, collective bargaining you can be fired whenever unfortunately, but the door goes both ways
That is why I would not give an employer any notice that I was leaving, Don't ever extend a courtesy they WILL NOT extend to you. If they try to hold your last check just contact the State labor board
I adopted this attitude after seeing people like you get the shaft at places I have worked. |

It all comes down to what state you live in. Where I live they have employment-at-will and that means that they have the right to fire you with no cause. You will be able to unemployment (it sounds like this wasn't your fault). Your local ESC will take down your side of the story and investigate it. I really don't think that you will be able to sue. If you would have mentioned the comment to the HR dept and it was documented, then you would have a better case. |

I feel sympathy for your situation but employees have very few rights. I was fired based on lies that a co-worker told about me. They only thing I could do is write my former employer a letter telling him that she had lied about everything and that if she does that to somebody else, maybe he should see what the other person has to say. That firing was sudden. I was called into the office and told that I was being let go because of an "incident" with this girl.
It really surprises me that employers can fire someone without just cause. It makes it very difficult for the employee to find work elsewhere and it almost is like slander. It hurts your reputation. Unfortunately there don't seem to be any laws to protect people. |

no kidding...and that really sux.
in your "second month of employment" your conference call should have alerted you that something was wrong. That sort of conduct during a business meeting should not be allowed. by you, your boss, by the company in general.
Well, you should file for unemployment anyway, and make them go through the hoops of proving your performance issues.. play the race card and go for it.
or. you can recognize that the world is full of shxt and try not to be consumed by it. you are a professional and your reputation should not be based on one xyz-hole.
Ive been fired.....for 'incompetency"....by a guy that never finished high school. but he was an azz and didnt want to pay unemployment.

Were any actual racist comments made?
By all means call and speak with a labor attorney, but make sure you file for unemployment.
From experience I know that you can remain angry and put all your energy into hatred and revenge while starving, or you can put it into a new job search. You may find that the next job is even better than you thought this one was.
Everything happens for a reason and for every door that closes another one opens. I know it is hard to believe this now, but someday you just might find it to be true. |

Were you on a probation period, this does appear to be a rasist incident so contact a lawyer and take an unfair dismissal claim. You will be awarded up to two years pay as compo! You can not be racially discriminated against even during a probation period |

Don't take this wrong, I don't mean to go at you, but from what you wrote, it sounds like you really didn't fit their team. Therefore they have a right to let you go.
Honestly, don't sweat this too much. Let it go and move on. You likely would have been miserable there in the long run. Be glad you only wasted five months! |

A place of business that you work in is not a democracy. As an employee you have two options work there or quit. You don't get a vote.. you get a paycheck.
If the phone call troubled you that much why didn't you quit.. maybe because the money you were making was enough to not make you feel 'that bad'.
Don't be stupid and threaten 'to sue someone'. Have you really ever done it? I doubt it or you wouldn't even make a statement like that.
Finally. Why do you want to work at a place that treats the employees like that? Seems to me they put you on the road to a company that respects people and rewards good work. |
