Fired after giving 2 wk resignation and working wk #1, what am I eligible for?

I gave my notice mid-week, reason being I wanted to go back to school for a Master's in my field. I wanted to leave on good terms and finish out a project that would end in about 2-3 weeks. I sent my notice via email to the CEO and my supervisors. In their responses, they stated how I have been a great employee, benefit to the company, hard worker, blah blah blah... and to please consider working for them in the future after I finish my degree. I truly believed that I was leaving on good terms, I have never been in any kind of trouble or made mistakes, and would consider them in the future if the opportunity was right.
Today, 1.5 weeks later, I was called in and fired. I was thanked for finishing my (main) part of the project and that a coworker will finish the remainder of my part. Therefore, I needed to clean out my desk and leave.
They cut me a check for yesterday and today. Should they pay me until my last day and can I qualify for unemployment?
I work in DC, live in VA, and was at the job for almost 2 yrs. Additional Details They said the reason was that they did not need me to finish my part, my coworker could take over... and then "good luck"

you can file for unemployment and may qualify for the half week(may not due to waiting period), most likely you will not qualify for anything more then that since you quit for school.
generally when you quit to attend school:
the job loss was your fault (you quit) and you did not have a just cause (going to school generally does not qualify as a just cause for unemployment), but since they terminated you early that qualifies as separation and the employer does not have cause to deny benefits.

as far as what they should pay, all they are required to pay is for hours actually worked. even if you were in a salary position they do not have to pay a whole week when you separate employment.

you do NOT file for benefits in DC the unemployment laws in DC do not apply to you..................

They paid you what you earned.Often times an employee that gives notice is terminated immediately because it is impossible to hold them accountable. If you show up late or do not put in all your effort toward your work what can the company do? Fire you? You are already quitting.. Move on You will have a hard time collecting unemployment when as a student you are unavailable for full time work. |

If you were working in a work-at-will job, then you can generally be fired, or leave on your own for any reason, or no reason at all. If you were under a contract or part of a union, then different rules may apply.

So the answer to do they owe you is: probably not.
You should consider applying for unemployment, and when you do, be sure to answer honestly about how you were let go: you were fired. If you were fired and they cannot show wilful misconduct, then you have a good case.

Determining Eligibility
To be eligible for unemployment compensation, you must meet the following wage requirements:
You must have wages in at least two quarters of the base period.
You must have at least $1,300 in wages in one quarter of the base period.
You must have at least $1,950 in wages for the entire base period.
Your total base period wages must be at least one-and-a-half times the wages in your highest quarter, or be within $70 of that amount.
In addition to wage requirements, you must also meet the following requirements:
You must be unemployed through no fault of your own.
You must be available for work. This means that you must be ready and willing to accept work considered suitable for you because of your past training, education, or experience.
You must be physically able to work. You cannot collect benefits while you are sick, injured, or disabled.
You must make at least two job contacts each week.
You must make a personal and continuing effort each week to attain gainful employment, using methods that are customary for your occupation. (You may be asked by your Employment Services Center to demonstrate your work search activities, so you should keep a record of such efforts.)
Reasons for Disqualification
You may be disqualified from receiving benefits for any of the following reasons:
Voluntary departure from your last employer without good cause connected with the work
Discharge by your last employer for gross misconduct
Discharge by your last employer for misconduct other than gross misconduct
Refusal to apply for, or accept, suitable work without good cause
Participation in a labor dispute other than a lockout
Inability to work or unavailability for work
Failure to register as directed with the Job Service
Failure to report as directed
Failure to participate in reemployment services
Failure to attend a training course recommended by the Department of Employment Services
Not being authorized to work, if you are an alien
A reasonable assurance of continuing employment* |
