I have been working for a retail store chain in my city since Feb '08. I was promoted to store manager about two months ago. Our store started off as being part of the corporate chain, but on May 1, 2008 our store was licensed out (franchised). Since then, this job has been completely different. Sure, the new owner made me store manager and gave me a raise...but that doesn't compensate for losing the insurance that was provided by corporate free of charge to me. Since he bought the store, we were no longer part of corporate, therefore we lost our benefits. So I have been working since May without any insurance. Which, in itself, I believe there to be something wrong with, legally.
Two weeks ago the owner came to me and said he would be switching ownership to another store in the chain that is approximately 20 minutes from this location. My co-worker and myself have basically been told by both the owner of this store and the owner of the parent company that we can either go with him to the new store or quit. There will not be an option for us to stay here. We were never given a chance to give a direct answer, nor were we directly asked if we wanted to go. We have essentially been told we were going. And then when we finally said "wait a second, we don't really want to move" we were told that in reality there was no choice given anyway. Go or quit.
Excuse me if I have something wrong here...but...shouldn't something like that be illegal in some way? This is not a question of it being legal for a company to choose to relocate regardless of how the employee feels...this is the owner of the company and the owner of the store we are employed at explicitly telling us that we go or we don't have a job.
Call me crazy...but there has to be something wrong with that. Additional Details The thing is that it is not a "new" store. The store we are moving to has been around longer than this one. He actually owned the one we are moving to previously, but opted to purchase this store after a while since our sales were better. They are not closing this location. The only thing that is changing, other than the staff obviously, is the ownership going back to how it was before he bought this store.

Briefly, if a company is sold to someone else then the new owner does have the right to set pay and benefits for the employees. In reference to your comment about losing your insurance. A company is not required by law to provide health insurance to it's employees, and a lot of companies are dropping these plans as they cost too much for them to maintain.
As far as the relocation offer to you, if they are relocating the store, or closing the store and they are offering you an alternative to go and work at the new place this is legal. And if you refuse to move to the new location and quit they can challenge your unemployment claim as you were offered a job and did not chose to take it. (Unless the new location is more than 50 miles away this is considered a reasonable offer of employment)

Some people would be glad to even HAVE a job.
That said, no there is nothing illegal about the new owner not providing insurance. And he can move you to the other store, and tell you that if you refuse, you don't have a job any more - that's legal too. If the other store was over 50 miles away, you might have some chance of getting unemployment if you didnt move, but if it's just 20 minutes away, refusing the move will leave you ineligible for unemployment comp.
Last I heard, the owners of the company make the rules, and decide who will be employed where, the employees don't just get to decide for themselves. |
