my bf works 4 days a week, 10 hours a day. (in a warehouse type place)
for the past few weeks they have been having everyone come in on fridays for overtime. if an employee doesnt show up, they get written up.
so this friday, my bf wants to not have to come into work but they are threatening write ups and saying that vacation hours cant be used.
is that legal? Additional Details we live in cali

Absolutely legal. The Company has the right to schedule hours of work including overtime.
The Company also has the right to approve vacation requests - No laws against this.
The Employee has to right to not work the scheduled hours, including the overtime.
The Company has the right to discipline, including termination of employment, for not working the scheduled hours, including the overtime. |

Yes it's legal. And if your bf can't or isn't willing to work the hours they need him, either he can quit or they can just fire him and replace him with someone else. |

Not using vacation hours is definitely illegal. However, working overtime varies state to state. I think that if she's getting paid overtime wages, it's fine (at least where I live). But I still don't understand what you mean by "forced"... |

you need to call wage and hour for the state you live in and they will tell you. I don't believe you can force someone to work over time. But, the law have been changed again. You can't take vacation days away. I know that one for fact. Most of it depends on if the warehouse is union or not. |

It Depends on your state regulations and if you are union or non union warehouse.
If you work in an union environment you have to abide by the contract. If you are a non union member but the warehouse is union then you still have to abide by the contract in place.
If you are a non union facility it should be on a first come first serve basis and it also depends on the needs of the business. If upon interviewing they stated that overtime usually comes up and you agreed to work OT hours then you need to work those extra hours. You made a verbal understanding that you can work those hours if for some reason you couldn't then they would have probably hired someone else.
Production is part of the business, if you cannot work the overtime then they will find some one else to do it. Its not illegal its a business necessity. |
