Forced to worked over 40 hours per week.?

I have been in search for a position as an Executive Assistant. I found a job ad but it stated the hours per week as such:

4 days: 9AM to 7PM
1 day: 11:AM to 10PM

It did not state that overtime would be paid for the hours over 40.

Is this legal to force someone to work so many hours (over 40)?

Would they HAVE to pay for overtime.

It may be important to note that they stated that this position would be the EA for a CEO of a restaurant chain.

If the job is paid hourly, then they must pay you OT for anything beyond 40 hours in a work week. However, depending on your state, they do not have to pay OT if you work more than 8 hours in a day.


If the job is salary, you are "exempt" from hour & OT laws. Salaried employees are simply not eligible for OT time pay.

The job is probably salaried, which means you can work over 40 hours, because they are paying you based on annual salary not hourly. Retail managers almost always work 50+ hours a week, for example.

I do work as more than 40 hours per week... we have a semi flex-time sched. meaning, i can come to work as early as 6am and as late as 10am. beyond 10am, i'm already late... well, lets go back to working hours... i have to render 9.6 hours a day from Monday-Friday. Though, Im paid every hour of that 9.6 hours. to sum up I work over 48 hours a week... most of the time, we have to render Overtimes either during weeknights or weekends =( bad though... but we need to contact our counterparts who are located in another timezone, so we have to either stay late or come very early, but most of them prefer we stay late... I think the 40 hours you mentioned, it seems fine to me...
