HELP... I need answers about labor laws in California?

I am currently working a part time job as a delivery driver to make extra money. I had car problems and called in to work. After this, my boss took all of my hours. I haven't work for about 3 weeks. MY QUESTION IS: CAN MY EMPLOYER DO THIS TO ME?? Is this legal?

Depends on the work.....if you are considered a private contractor....they can...if you are not..they can....they didn't fire you..but it seems they are just trying to force you to quit...If I were you..I wouldn't even try and go back..and find something else.

First: Delivery jobs (such as pizza, chinese, flowers, etc..) are completely "at will", and I suspect that you signed a document (usually within the employee handbook) stating as much. Unless you work for a courrier or trucking industry, you should consult your employee handbook.

Second: It is not hard to find probable cause to fire someone. For instance, if you are using your own vehicle, your employer counts on you to keep it in running condition, and anything that kept you out for more than a day or two, would qualify as faulty equipment. You should ask your boss.

Third: Future employers don't put much stock in part-time second jobs, so just get another.

Yes it's legal - they can schedule you or not as they see fit to do.

The answer is, yes, it is legal. Most employees in CA are employed "at will", which means you can be terminated (or quit) at any time, for any reason.

That being said, it seems to me to be excessively harsh if you only called in one time. If you have been making a habit of calling off work, this is your employer's message that you should probably find some other way to earn a living.

Yes. Although if it is as you described and not your fault, your employer has now seen you as someone who is undependable and has given your hours to other drivers. It seems a little harsh, but he has a business to run and needs someone with dependable transportation.

I personally think he's over reacting and should give you another chance, but he is not doing anything illegal.

By cutting your hours, he's probably hinting to you that your services are no longer needed. I went through something similar at a sporting goods store I worked at once, although my hours were cut to nothing because the sport I specialized in was out of season. I was not given a chance to learn something new, they just never scheduled me anymore and I finally had to quit.
