My husband just recently got fired over something that he shouldn't have been fired over.
His boss is an intolerable cow and even towards the very end she didn't give my husband a time or place to defend himself. She's broken A LOT of rules in the job realm. I'd consider making your employees stand up for 9 hours or more without take even one single break to eat or rest is a crime in itself, but this goes further then that. Do any of you know any places I can file a complaint without having to hire an attorney? I want to place a complaint, but I'm not wanting to take this to a court. I was this to be taken care of without the attorneys/court involved. I want this woman either fired from her current position or this job site to be fixed. We are now without a job. And our family is going to suffer now. It's hard enough finding a job these days. So, I'm obviously furious. Please help me!!!! I need to place this complaint.

In many states (but not all) it is required to give 1/2 hour or more for a lunch break. Check your state labor department to see, or to file a complaint.
Being an intolerable cow is not against any regulation, alas. I've had my share in the past. |

I am pretty sure there are places, but it depends on what state you live in and their legal rules about jobs etc. Also it depends on your husband's job policies. If his job says that his boss hasn't fired him wrongly, then there will be nothing either of you can do. It starts with the policy so I would go over his employee handbook or whatever very carefully before making my next move. Other than that, if you intend on trying to get this lady fired, that's gonna be hard and unfortunately I'm pretty sure you'll end up in some kind of court. And do not ignore that if you go after her job she has a legal right to go after you and your husband and she can very well sue you if you guys try to get her fired.
It all starts with an investigation and that would be the next part. But before you do anything, go over your husband's work policy to make sure what she did was wrong. As for your husband not having breaks, does this job have a union? And if not, why are the employees putting up with this? This is something that should have been brought up before your husband got fired. It looks funny that he found this treatment unacceptable but didn't voice any complaints until now. They're gonna look at that and wonder why. It appears that if he hadn't gotten fired, would he have continued putting up with her so-called unfair behavior? Gotta look at how it's going to be perceived by others who may look into this matter.This is the first thing that's gonna be asked if it gets to an investigation.
But, check the policy. I recently learned that every job doesn't have to give you breaks or even a lunch break anymore. Surprising, but true. So before you think the boss was breaking rules, read that handbook. She may not have been. You can't just say someone is doing wrong because it "seems" that way. People aren't going to care about that, they're looking for evidence that she did something wrong and that your husband should not have been fired. It will only take one little thing for them to find and they can blow this out of the water. Also, did you know that bosses now have rights to fire employees without any kind of warning or notice? It's true. The workforce is changing. She can fire him if she doesn't like his shoes. Believe me, it's the truth. In many cases bosses do not have to explain or even have a logical reason to fire someone. That's one of their rights.
It all comes back to the rules. Sorry your husband lost his job and wish you the best. |

You can file a complaint with employment office and the labor department in your state. Also, your husband can file for unemployment benefits. |
