Heres the low-down: My wife works part time for minimum wage at William Sonoma in Massachusetts. As the store is in the mall and the rent is high, they are obviously a frugal business. However I am wondering if some of their cost cutting approaches are actually legal...
She is constantly being given take-home baking assignments for store displays and is required to bake cakes at our house with our electricity and she does NOT get paid for them. They have already told her when she requested that she bake them at William Sonoma that she can, but she CANNOT clock in for it.
It is taking a toll on her, within the last month they have had her do almost 20 cakes, and hasnt been paid at all, neither for the electricity nor the labor. They reimburse her for the materials, but thats it...
Is this legal for a business to do? It seems fishy to me, the reason this whole exchange works is because both sides get something, companies get labor and employees get money. If shes not getting paid for these "homework assignments" then why should she have to do them? (Yes, they said it was mandatory.)

No, unpaid time or assignments are only legal if she is exempt from the federal wage and hour law, and as a minimum wage clerk she definitely isn't. The store manager is very likely exempt, but not a part time minimum wage employee. She can report this to her state labor department. Would be good to have another job lined up first though. |
