HR Qt - Is it legal for an employer to insist that I use vac. time for 1st 2 days of my sick leave?

If you are out for 3 or more days, they take the first 2 from vacation time (combined time off) and then the third day you can take from your sick bank.

According to the U.S.Department of labor,there are no federal legal requirements for paid sick leave. For companies subject to the Family and Medical Leave Act (FMLA), the Act does require unpaid sick leave.
Further, he Fair Labor Standards Act (FLSA) does not require payment for time not worked, such as vacations, sick leave or federal or other holidays. These benefits are matters of agreement between an employer and an employee.
Hence, the it is legal for an employer to insist that I use vac. time for 1st 2 days of my sick leave.

fringe benefits are not mandated by law and are a matter of company policy. all that matters is they equally and fairly administer policy, as long as the employer does that they have no legal issues to be concerned about.

Absolutely. Sick time is not mandated by law. Neither is vacation time. The use of it is strictly company policy -- therefore it's totally up to the employer how such leave is handled.

Yes, if you're a temp or contract worker who is not entitled to sick pay, or if you're a new employee who has not yet accrued enough sick days.

Also, if you are a new employee and therefore still in your probation, it's in your best interests that you take it as vacation as you can be dismissed at the end of your probation for having taken too many sick days, even if you genuinely were sick and had a doctor's note to cover it.
