recently i rented a car from enterprise because i got into an accident.. i went through insurance, but it went over the maximum number of days of renting a car.. enterprise told me afterwards that i did not need to pay anything after telling them of the situation and me going over the days because the body shop kept my car a bit longer.. the guy helping me told me he would see..and then he told me everything was alright and that i did not need to pay anything... then later they call me telling me i owe them money for the number of days extra which i had the car... and i told them that i had talked to this guy and that he told me i did not need to(i got a paper where i signed saying i owed $0) then they told me they made a mistake and for me to pay for the days passed. i argued saying it was partially their fault for telling me that..and i want them to pay half the amount at least. because technically i signed a paper saying i did not owe anything and that it was their fault for telling me i did not owe them anything. and now they took out the money out of my account after telling them not to until after things are talked through. i also told them it would be paid in a different card too because i did not have that much money in there.. what should i do? please help me. thanks in advance

From the information that you provided you should be fine. There are tons of options:
Try to figure out how much they want to charge you and let your bank know that there may be a discrepancy from the company.
Stop all payments for the company with your bank / credit card.
Talk to the manager and respectfully explain you have a signed contract saying you are paid in full and if they do not work with you then inform the company that you will be contacting the Better Business Bureau (BBB) about their actions.
You want to take care of this at the lowest level, but make sure to keep the rental agreement sheet saying that you are paid in full to protect yourself in case you have to go to small claims court or something along that. If they charge you, then they end up sending you to a creditor, etc it could be difficult, but then you could sue for damages in small claims court and probably win several thousand over your cost for your suffering.

Documentation always beats conversation. If you have a document stating that there was a $0 balance which occured prior to the charges you can probably take that to your bank or credit card company and dispute the charges.
I've had to dispute against erroneous charges before and HSBC VISA was really good about it. I'd check into that directly with your bank/credit card company to see what kind of recourse you have.

If you entered into a contract, then you are bound by the rules.
If enterprise wants to change the contract after the fact, you owe them nothing!
Pretend the original contract is the only one that matters, please remember that sometimes you are talking with a low-level associate. Always ask to speak to a supervisor. Enterprise is a good company, do your stuff in writing from this point on, and request for them to notify you of everything in writing also.
You can print out the answer above mine also, and give it to them (as a copy). If you are a procrastinator and irresponsible person, it might be easier to just pay it and move on. Stay organized, create 2 seperate folders, and be on top of things and you'll do well.
Businesses are usually effecient and want to resolve cases asap because problems such as these tie up a lot of resources (time and labor-hours and paperwork) |
