If a person is on top of a building getting ready to commit suicide with witnesses watching but right before he gets to the ledge he trips over faulty wiring busting through a weak area of construction and over the edge. Who is at fault?

A defense for the construction company is that they could not have known that a person would walk on top of the roof so near the ledge to cause him to fall to his death. Since the path was not intended for pedestrian traffic and the person had intent to commit a crime, the construction company would not be liable.
