Hi, I'm applying to be a Fire Fighter but I have a record that expunged, do I have to disclose that or no?

I was arrested but never convicted, my fingerprints were taken also. To complete the application I have to sumit myself to an FBI background investigation that includes fingerprinting. I guess my question is do I have to disclose that information to them even though I could legally deny ever being arrested and would they be able to see my record?

It totally depends on what they ask in the application. If they ask if you've ever been arrested, you have to say yes. But if they ask if you have ever been convicted of a crime, then obviously you answer "no" and any background check should support this.

Some states only allow for you to be asked if you have been convicted, in that case, you skate. You should also consider if during your expungement you got your FBI records back. If not have your lawyer contact the arresting agency and have them returned. The FBI will send them to your laywer thru the arresting agency.

My friend you have to disclose all the information asked without keeping anything so that it would not spoil your future career with them.

when they FBI does a background check they see everything including sealed records ,arrests, and expungments
