Hotel security guard gets fired for taking soap and snacks?

The employee signed the application which stated that he could be fired at any time. The company has a manual that allows employees to rec. two prior warnings before being fired, but could be terminated immediatly to severe fule violations. The employee was fired on the spot for taking some soaps and snacks which the hotel provides free to its guests. Can the employee sue for wrongful termination and if so what would be the companys liability.??

Courts tend to allow firing at any time for theft or any activity that would suggest the employee could not be trusted if trust is important to the position.
Because the manual does warn that one can be terminated immediately for some unlisted offenses, they are covered as to a policy. |

stealing is stealing ,, just because they are offered free to the guests does NOT Mean that the employees get to take them home..
NO, the employee can NOT sue for wrongful termination.. |

If the position is in the US and is "work at will", which most are, then you can be fired or quit for any reason or no reason at all. Theft is theft no matter how petty - but anyone can sue if they feel they have been wronged. The best person to answer this would be an attorney that specializes in labor law in the location that this happened. |
