How Do You Know When You Will Get Fired From Your Job?

Sometimes people have no idea they are getting fired without being notified. Is that also against the law if their employer does not let them know that they are getting fired from their jobs?

Don't worry about it. Just always be prepared. Anybody can lose their job at any time, even if they've been with a company for a long time and have done their job well. Keep your skills and your resume up-to-date. If you've been coasting on the job, be sure to upgrade your training and skills beginning immediately. Even if you can't afford it, there are free resources on the internet and in your local library.

When you come to work one day and somebody else is sitting at your desk, that'd be a good indication that you got fired

No, that is not against the law. Most states allow employers to hire and fire at will.

It is not against the law to be fired without notice if you are or have been in clear violation of a company policy or code of conduct. You may also just be fired, just as you are able to just up and quit. Alot of larger corporations or governemnt entities have a warning system, like you are reprimanded or given a written warning and then so many of those equals being fired, but that also would have been in your employee hand book, and may have allowed a grievance process on your part. Some places also can fire you, like in the ever popular down-sizing routine and not have to tell you before hand, but surely have a legal dept. that told them how to do that firing. Hope that helps.

Good question...first if you are answering are you afraid that it may be you? Most people would know that they may be on the "cut" list if"

1. The company is downsizing.
Due to some economical setbacks some companies are giving pink slips to some of there hard-working employees, most of who have been with the company for a good while.

2. Performance.
Is your performance up to par? How was your last review with your supervisor, have you been reprimanded a couple of times?

It could be a number of things, but if you suspect you may be gettin cut soon, you have Hotjobs, Monster, and Careerbuilder to help you have a plan B.

Unfortunately there usually are no signs you are going to be terminated from any job. You are more than likely in an Employee-At-Will-State meaning you can be terminated at anytime without cause and you can resign at anytime without cause as well. Unless it was a wrongful termination based on a state and/or Federal law (state law supercedes Federal law) you have no legal grounds.

Employment (labor) law varies from state to state and lots of states are what you call "at-will" work states - in other words, an employer can terminate you for any reason, or no reason at all; with or without termination advance notice. The only exception seems to be those cases that involve discrimination of some sort (which has to proved, of course, and guess where that burden of proof lies?). Your state might be one of those kind. Check the labor law area of your capitol's website. As for more subtle signals that you yourself can watch for: getting invited to less meetings, seeing proposed org charts without your name or position on them, noticing your removal from group e-mail lists that you've been a member of, getting less e-mail from supervisors and peers, removal from projects that you've been involved with for a while without a corresponding replacement of that workload, termination or reduction of your network rights and privileges to certain programs or servers within your organization. That all spells trouble. Not every organization lets employees "go out with class" - even the largest and most sophisticated.
