In agreement with Jeff. If they give you a bad recommendation and disclose this information they are opening a can of ugly legal worms. As one poster wrote regarding forms that you sign relinquishing a former employer from any liability for telling the truth. Well, totally not true and if such a form exist it wouldn't hold up in court. Most smart companies only offer dates of employment, position, and last salary earned (with permission from prospective employee to get this information.) Nothing more. The only time a former employer can give a negative reference without facing any possible legal consequences is if you are a danger to yourself or others. In the event lets say hypothetically you were let go because you showed on more than one occassion you had a violent temper and actually caused injury to another person, yourself, or company property the former employer would have to warn the new employer of this. If you were not at this place for a long period of time you can totally nitch even including them on your resume. |

They can not tell a new employer of the unproven theft without having prosecuted you or risk slander problems.........so you can use them as a reference and hope no one is stupid enough to go there. Or if you have allot of previous experience or have other references forgo them all together. Our you still close with any of the people you worked with that could write a recommendation. Also can you call and ask your previous employer what their intentions are if they were to be asked for a reference? Maybe they have since found the real culprit and would have a good reference for you? |

With a background check they contact former employers, verify dates of employment, salary, position title, and why you left a company. Once you sign a release statement you are releasing former employers from liability for giving out truthful information about you. Employers who are more conscientious will do their own check and call your references on their own.
My suggestion is you do not include this company on your resume or any applications that you fill out. There is no way for them to know you worked there unless you tell them. And there is no "good" way to explain that kind of allegation and termination to a prospective employer. Better to show a gap in employment. |

I personally wouldnt but it on mine, I would rely on another past employer for a reference. If you didnt do it, you should have handed your notice in before they sacked you for it, that way they cannot say anything bad about you as it wasnt proved. |

Your resume never mentions *why* you left a job, just how long you were there and what you did.
Your application might ask why you left, and since the accusation was never formally charged, you probably don't have to mention it. You probably should in the interview, and explain the situation, as a sign of good faith. |
