How do I become a legal represenative of my mom after she passed away?

My mom passed away in December of 08. I was her POA when she was still with us but it is no longer in effect since she passed on. How do I become her legal represenative and will that make me responsible for all her debt before she passed?

Well when my father passed away I had to hire a lawyer in the city were he passed away, it was a lawyer that took care of wills and estate. The lawyer has to do a probate, you gotta fill out some paperwork and get it notarized then once your named primary benificiarary (can't spell that word) by a judge then you can get all of the deceased estate, but shop around for lawyers cuz some charge way too much.... If she didn't leave a will, you'll need to go to probate court and be named the administrator of her estate.

You will be responsible for paying all her debts using *her* assets, including any property that she owned, which may need to be sold if she did not leave enough funds in her bank accounts to pay all her outstanding debts. You will *not* be responsible for paying any of her debts out of your own personal funds.
