For several years now employees at the lower level of the company I work for have had problems with their paychecks. The boss insists that checks are mailed, as opposed to picking them up in the office or using DirectDeposit. So we always get our checks late in the mail, then when we go to cash them, the bankers tell us "there are insufficient funds" wihich means we don't get the money that we work so hard for and need to pay our debters.
My coworker has two attorneys (one criminal, one civil) and the one we spoke to who is the criminal attorney told us that each bounced check is as bad as counterfeit money.
Our boss is commiting federal offenses with every check he stamps his name to that bounces.
Any suggestions as to the actions I should take so as to serve justice to my fellow employees and not lose my job?

The company needs to be reported to your state's department of labor right away. You are protected by the whistleblower act from being terminated for that. The owner of the company and/or whoever is responsible for getting paychecks out is guilty and needs to be punished. There is no guarantee that it won't put the company under, but that should not be your concern. You are not getting paid for the work you are doing for them.
Companies are required to post the time and place that paychecks are available to the employees. Mailing is acceptable, but they must be postmarked on or before the posted payday. If you still have the envelopes your checks came in, check the postmarks. That could be another offense.
Finally, even though you are protected when reporting them, I would start looking for a new job right away. Fooling around with the company's money that causes employees not to get paid will only lead to more disaster for you later. |

If he's not paying you for your work, why do you want to keep working there? Make copies of the checks each time they bounce and then take it to the DA's office. |

There is not way to be free of losing the job. Because that will be more based on what happens to the company. (Something similar happened to my mother). But if you think it is the right thing to do (and I think you do) you should gather all the info (and you need facts, documents ect) and take it to the proper authorities. This will probably prompt some sort of audit or investigation in which all info (yours and fellow employees as well as the bosses) will be "looked over". Find another job, because whats a job when you dont even have the security of your paycheck being valid. Its not worth it to be concerned of your job status. Find anther one asap... and when they ask why you want to change jobs... dont go into detail. Keep it simple. I hope that helps and I hope you make the right decision. |

If you aren't being paid for the work you do, why would you even worry about protecting the company? The truth is, the law protects whistleblowers and in a case like this, your co-workers are likely to be on your side. Besides the criminal charges, you boss could also be subject to large fines by the labor commission. |

Check with your local Labor Board. Just check with local information 411 for the phone number. They will either handle it or point you exactly where you need to go. Good luck |

You need to talk to authorities for sure. A lawyer would be a good start. Do not hesitate, its obvious he doesn't care about your situation. |

Contact the state Labor Board right away. Call them directly, you will need to give them details, like when it happened, how often, to whom (you have to be certain of this one. You can just say yourself if that is all you can be certain of.)
No state will allow an employer to rip off the employees. Contact the State District Attorneys office if you cannot find a labor board. |

Does he make them right?
The legal system cannot prosecute everyone why bounces a check.
I would find another job, that one seems to be heading nowhere fast.
You should get ALL of your money, if you have outstanding insufficient funds checks owed to you, take them to the county attorney, they will collect them for no charge.

Do you know that the rubber checks are indeed his fault? If there is no money it may not be in his hands. Does he own this company, if not odds are his pay check is not clearing. Non Suf Funds means NSF for no one. If the company is in this crisis I am surprised you and fellow coworkers have stuck around without explanation. Look for a new job!!!!! Good Luck. |

I have had a job like yours in the past get out he will be losing his company soon and you wont have a job to worry about. that is the first sign of the company going belly up find another job and tell others to do the same.

File a claim with your local wage and labor commission office (if you are in the U.S.). Employers are not required to offer direct deposit of the checks and some do not due to the financial obligations involved to set one up. But they are definitely required to pay you on the day they have posted as the payday, and the funds must clear. |

Call the IRS and the better business bureau and report him, I think you can do it without giving your name. Also, the employees could get together and sue him for the wages that he owes them. Besides, how long before he bounces your pay cheques if he already has not done so. Why are you worried about losing your job especially if you are not getting paid for your work. |

If the checks bounce - its because your boss has no money.. So what good would it do for you to try & turn him in. That doesnt make sense. How do you expect for your boss to be committed and you keep your job -Besides, as long as your getting paid - late or not - he's done nothing wrong. You are after all - still getting paid for working. If your not happy - either find another job or deal with having to wait for payment. |

Have one of the lawyers point you in the direction you need to go.. They should be able to tell you how to go about a lawsuit against him. You could also contact your local business bureau and see if they can help you. Good Luck... He sounds like a real Idiot. |
