About 5 years ago I bounced a $32 check on accident. They took me to court before I had a chance to pay for it. I payed for it in court and ended up with check deception on my record. Now I have been hired several places, but with this on my record they won't let me work. It really hurts because the welfare is going to take our families food stamps away because I don't have a job yet. I explained to them that I am more than willing to work. And had been hired at a great company, but with this stupid little thing on my record I can't. Any advice? Oh, and I live in a small town where my job choices are limited.

In response to the two answers so far, I did call a lawyer to get expunged, can't do because I was convicted as an adult. And the jobs I've applied to do not involve money in any way at all. Local unemployment office does not do bonding.

I'm not sure if this is possible, and if it is, it is expensive, but you could try to contact a lawyer to see if you can get the charge expunged from your record. I know they do that with MIPs (Minor in Possession). Good luck. |

I know in Florida you can participate in a Bonding program through Workforce (unemployment agency) that will give some 'insurance' to an employer to help in taking the risk out of hiring you. Start with your local unemployment agency and see if this might be avail in your area/state. Most jobs these days require background checks, maybe try also for jobs that do not require direct contact with money. That would be a businesses concern.
How long does this remain on your record?
Keep your options open - sometimes any job is better than no job until you can do better. Good Luck!

Somehow, I don't think that you are telling the truth here, you cannot get convicted for bouncing a check especially if you pay it. You only get convicted if the case was taken to trial and if you agreed to pay then that wouldn't happen. It's just a misdemeanor and yes you can get a misdemeanor or felony expunged from your record. You just go to the County court building and fill out a motion form titled Motion to Expunge and prove your point. If it's really been five years and it was only a bounced check, there should be no reason that a Judge would not expunge it. It's a very simple process and you do not need an attorney. They will schedule it to be heard in court on motion day and most likely if there have been no other instances of misdemeanors or felonies, the Judge will expunge for you. Good Luck. |
