How do I get my backpay?

I work for burger king and for the past 2 years I have payed on medical bills in collections by getting my paycheck garnished. I made my last payment in person because it was only 30 bucks and they put a stop payment order into my payroll dept. But it was already too late and the payroll dept. garnished 129.51 from my paycheck. Since collection was payed off in full they sent the chack directly back to the payroll dept. I called the payroll dept. and they say thaey have never recieved anything back from collections and they tell me to get my money from them. I then further investigated this matter with the collections dept and they in turn tried themselves to contact payroll but they never returned any of their calls. I have also called and left many messages with my phone number and contact details but have not gotten any return phone calls. I am on a fixed budget and am currently on housing assistance and live from paycheck to paycheck. I have had to pay late fees for bills unpaid as a reult of this missing money. I am not sure what I should do or what my rights are exactly so anyone with some usefull info please help.

threaten a small claims lawsuit. then file one if they don't pay you the money, plus the late fees you had to pay because they didn't pay you the money when they should have. look up how to file a small claims suit in your state - it's easy.
