If he/she takes your case on contingency and gets paid if he/she wins, odds are they will earn their money. This is not complex law and most company's settle out of court quickly to avoid legal expenses and public exposure.

If there are flaws to your case the attorney would have kicked you to another lawyer or the street.

The average fee is 1/3 of a settlement, or 50% if it goes to trial. This is for a case taken on contingency. If you have the money it may be cheaper to pay the attorney by the hour.

my guess would be if you win the case

part of your lawyer being "good" is your relationship with him or her. The level of honest communication between the two of you is vital to the success of any case.

another tool that you can use to evaluate whether you have a "good" attorney or not is to contact you state bar association and ask about his success rate on the specific type of case (s)he is working on for you.

And, of course, the ultimate determination is how your case ends up and whether or not you win.

With workmen's comp. cases they typically never see the inside of a courtroom. Companies try to avoid trials over issues related to workplace conditions due to the fact that the "conditions" then become a matter of public record. When our firm represents an employer who faces this type of litigation, if they company decides to settle pre-trial, we have the individual who is suing sign a non-disclosure agreement which prevents them from disclosing the details of the case and if they violate the agreement, they have to re-pay the money given in the settlement.

Best of luck to you!!

sorry that almost everything others have written is completly wrong. if you win or lose doesn't tell you how good of a lawyer you had. the bar doesn't keep statistics like major league baseball. and lawyers can't charge 50%.
best way to tell is recomondations of others.

go to wsba.org and look them up. at the very least it will tell you if they have been reprimanded or have been disbared for being unethical.
