How do I sue my job if they aren't paying me for my hours?

I really hate this job! I work for the Hilton and everytime I stay over time they don't pay me! Or if I work w/out a break they'll still take it out of my pay! It's not fair! What kind of proof would I need in case I may want to sue and what will an attorney ask for?

contact the hotel manager and file your complaint.
if that does not resolve the issue contact the corporate HR department. if they fail to address your issue and pay your back wages file a wage complaint with the department of labor/workforce commission which ever it is in your state. they will investigate for you and if there are any violations they will mediate a settlement for you.


you have no need to sue a lawsuit will probably get you less money then the state department of labor will (the state does not charge you).

If you have no written proof of this, then what is in the computer stands. Take a sheet of paper with you and get the mgr to sign it before you leave each night. Keep track of them and when you see the discrepancy, report it.

Suing should be a last ditch effort.

there should be a state labor board that you can just file a complaint to. Also call the head of Human Resources for for Hilton. I guarantee you that it is your local manager or payroll person that is doing it and if the higher ups knew about it they would pay you. What you describe is against the law.

I beleive you can take this to your local work board commission....They usually can help workers in situations like these...And a lot of times I don't even think it costs you much if any thing...Good Luck! I hope you get what you are owed!

You can sue in small claims with no attorney.
Or enlist the help of your state's Labor Comissioner.
Keep handwritten records-they're often good proof in such cases. An attorney is always trained to ASK FOR A NICE BIG RETAINER.

when u signed up for the job, did u read the agreement? every job has it's worker's rights. Please try and get a copy of that agreement from somewhere, and read it CAREFULLY. If it does say something about the right on the issue u r facing, then BOOM! u have a solid proof.
