How does it work if you're currently on temporary medical leave and want to quit for a new job?

My Dr. placed me on temporary medical leave last week and expects it to last about a month. After I was placed on leave, I was offered a job for a different employer that starts in July.

I work for a private entity which has a private disability insurance provider. Our employee handbook states that they reserve the right to expedite notice…so if I gave two weeks notice they could just say, “That’s OK, today’s your last day.”

To complicate things, I also have a pre-approved vacation the first week of June.

How should I handle this?

If you are on medical leave, I would use that time as medical leave to avoid problems with disability insurance. Most places require a two week notice in order for you to be paid for the remaining vacation time you have left. Turn in a two week notice and opt to use vacation time if they allow you to do so. That way you have done your obligations required by employer to get the vacation time paid for that you have earned and can start your new job with a clean slate. If you have something pre planned before you start your new job, let them know. Since it is something that was already planned before you start working with them, they should not have a problem with that.

If you're on medical leave - you probably wouldn't pass a physical for the new job and if you leave now - forget about the vacation

Yes, they could just say today's your last day. And since you are out on medical leave, that's pretty likely.

Most places will pay vacation pay if you quit before taking your vacation.

Businesses do not have to follow their own employee guidelines. They can fire you today. Most states do not require vacations, lunch breaks or breaks at all.

If I were you. I would contact to new employers ask for a firm hire date after your doctor releases you. Then professionally resign. Use the free time as a vacation until you start the new job, and wait for your last check which would include all earned, unused vacation time.

If you quit, forget about unemployment benefits.

This is totally a character call.

You could:
A) Milk them for the medical leave and take earned vacation (I'm assuming its paid here).
B) Get back to work, take your earned vacation, then quit.
C) Just tell em all bets are off and you are moving on.


If the vacation is paid, I'd take it since you have earned it. If it is just approved 'time off' - I'd just cut the cords now.
