How does unemployment work? Breakdown please..?

whats the concept or process behind it and how it works? I hear that people get fired but then just get unemployment..I don't get it.. its like they getting paid to be fired? I don't see how the system works, fired but get your paycheck 100% thanks to unemployment?

1. what if you get fired... i.e. work avoidence

2. if one does get fired.. what should one do to protect themselves? i.e. sign OR don't sign any paperwork upon the "exit interview" ?

3. What happens if you DON"T sign any paperwork if and wen you get fired?

for unemployment you must lose the job through no fault of your own
it does not matter if you quit or are fired it is WHY it happened.

there is nothing that you MUST sign at termination that will help or hurt your chances of drawing benefits. as noted above be wary of what you sign and what it says but also realize that refusing to sign things such as a counseling form does not help you(a witness can sign stating you refused to sign and it serves the same purpose).

an exit interview is used by the employer to learn where they can improve so as to decrease employee turnover.

in many states the employer must file with the state when an employee separates employment and they will list their reason why the separation took place.

those who draw benefits do not draw anywhere near what they made being employed. they draw a percentage of what they made and there are maximum and minimum amounts of benefits. your benefits are based on earnings in the base year which is usually 15 to 18 months prior to separation and then they use your highest quarters earnings to finalize the benefit amount.

unemployment insurance is a federal program that is administered by each individual state. each state has a website that describes the process, how it works, how to figure benefits and explains how to file as well most have the ability to file the initial claim on-line.

Well, from the beginning, employers play unemployment taxes for the first $7,000 an employee makes in a calendar year. They pay 2 types of unemployment Federal Unemployment taxes (FUTA) and State Unemployment taxes (SUTA) - it's not very expensive.

FUTA = .80% of the paycheck for first $7,000
SUTA= varies by state but based off their past claims

It doesn't matter if you get fired or quit, you can file an unemployment claim, that doesn't mean you are getting paid though.

After you are quit/fired and file the unemployment claim at your local unemployment office they will assign an adjuster to basically look at both sides of the case (employee and employer) and determine if the claim should be paid.

In my opinion, it doesn't matter if you sign the paperwork or not on the exit interview. However, careful what you sign, and make sure the wording on it isn't going to prohibit you from filing anything that you may be filing against the employer. Employers are trained to document everything and probably have a file of things like if you showed up late, or called in sick, ect.

Typically nothing happens if you don't sign paperwork. It depends though, take me for example, if I leave my company for any reason, I get commissions for 2 years. The flip side of that is I have to sign paperwork upon exit, and I cant target my clients once I leave.

Bottom line, be careful what you sign and read it carefully.
