If you are being made redundant from a specific job, the Company can NEVER re-advertise the job.

There is no specific time.

To make you redundant the company need to prove that your job no longer exists. If they make you redundant and win a big contract 1 week later and this leads to them needing an employee to do your previous role then they would be able to advertise for your old position.

The 3 months that other people have referred to is the time limit for bringing a claim to an employment tribunal for unfair dismissal. Seeing as this can be extended to 6 months by the grievance procedure it is not the basis for saying that a 3 month time period has to have elapsed before a job can be advertised.

If your job is re-advertised within 3 month of you leaving, you will have a claim for unfair dismissal. An employer can't make an individual employee redundant as such, they can only make your job redundant. Re-advertising the same job shortly afterwards is a strong indication that you were moved out of the company under the guise of redundancy. If you were made redundant make sure you get a written explanation stating that your position is surplus to requirements, then if it is re-advertised up to three months later, consult a solicitor specialising in employment law.

An employer can not have someone else doing the job in the same job title for a good few years before the same position could become available again.

I was made redundant and then did work for the same company doing the same job on a part time basis as a contractor from home doing less hours. I have still not been paid for that work so any extra leverage to get paid would be handy. Should I seek further legal advice about what happened?
