been convicted to a small misdemnor. Lets state I was almost 4 years go in RI. Something stupid. I have thought all along that it was a closed case after the 6 months of "stay out of trouble" probation. So I have put a check mark near the NO box on applications all along thinking it was correct. Well the position I took recently is a temp to perm and the women that owns the placement office has been working with me because this stupid charge is showing up on my record. I plead no contest so it is a conviction. So I went tru the process to get the case expunged and find out this morning that it has not been 5 years so it was declined. After hours of running around, paying for a record ect....So I may loss my job if the new company is not ok with it. The owner at the placement place is making it seem that I mentioned there may be something and we worked on finding out, she then found out that in deed there was something but it was a stupid charge. How the hell do I answer the damn question on applications now? All along i thought I was ok...I hope this is only a small bump in the road..Do they only pull background searches from the states you say you lived in. hell I was only in Providence for 6 months in the last 8 years. I do not mention Providence and I am golden?HELP Additional Details The reason I mentioned leaving off an address was because she showed me the report they ran and they only ran it on states I have lived in. Employers want to know if you've been convicted of embezzlement or theft, for example, before they give you the keys to the bank vault. They don't care about small misdemeanors, unless it's something relevant to their business -- if you owned a retail store, would hire a convicted shoplifter?
Be honest. Explain what happened; the fact that you've already dealt with this company as a temp will indicate that they know whether you can do the job and fit in with their organization's culture. Depending on the particulars of your background, they may not care about it at all.
As for how to answer it in the future. . . the question's not asking about small misdemeanors, like speeding tickets -- otherwise everyone would have to check "yes"! But if it's something that's going to show up on the background check and raise some eyebrows, then you're better off writing "minor misdemeanor -- will explain" on the application than trying to sneak in undetected. You never know where those pesky HR people are going to dig! |

If you pleaded "no contest" that is the SAME legal weight as pleading guilty...you agreed to accept the punishment as if you pleaded guilty.
If your record is not expunged, then yes, you have to report it or any background check will pick it up.
LEAVING OFF AN ADDRESS DOES NOT HELP YOU...they run a social security trace on you that is a smaller version of your credit report without the accounts...this lists everywhere you have ever lived and the dates, so if you left off an address, they will check it against the social security trace, and then check that county/city, and that is how people get busted.
Don't think you can outsmart the background check b/c they are already "onto" that trick. |

Every state and job has its own requirements. Some places only require you to state felonies. But some jobs will do an extensive background search anyway. It all depends on the kind of job you're applying for. (i.e. State, Federal) |

Just answer yes, but then write in, "With an Explination", Then explain to the interveiwer that the charge was 4 years ago and that it was a minor indecretion on your part and that you have moved on from that and that you hope they can see that also. Most likely the person will appreciate your honesty and let you have the job. I have interveiwed several people that have done this very thing and all of them have gotten the position they were applying for. Good Luck! |
