My boss called me into her office this week to tell me that Human Resources was wanting to cut my pay. I have been on my job for 12 years. They are saying that I make too much money for my position but I just received a raise 2 months ago. I have a different boss and different HR than when i started my job. I was promoted to my position after the former supervisor died. I was the next most qualified. HR approved it. They also approved me getting a pay raise with the promotion. I have been in the same position for about 8 years. So, can my employer do this? I searched on the Department of Labor but there is so much stuff on there I couldn't find what i was looking for. Could someone please help me out?

I'm a surgical tech that is over the autoclaving department. HR approved the job when i got the promotion. now they are saying i shouldn't be in that position. this isn't an across the board pay cut. it's just me. and also they want me to do more stuff for less pay. working in 2 departments on 2 different pay scales.

Go and see your H.R. department to ask why this is happening and what is the reasoning behind it. There are no laws in the U.S. to state that an employer can not issue pay cuts. Is it a company wide pay cut? Are they instituting some kind of pay range structure and your pay falls outside of the top range? Find out, because if they are putting in ranges and you have to come down to fit inside the range then you may be in a situation where you will not be entitled to any further raises until they change the pay range. Better to find out directly from H.R. and know what you are facing. Don't take someone elses word for it. |

They can. Salaries can be changed up or down. Your only real option if you aren't willing to take the cut is to look for another job. |

Are you being given the offer to have your pay cut? If it is, then find out why, then if it is because they are instituting a pay range, tell them that they have two options, the first being that they can promote you to the position that your pay falls into, or you can negotiate an exit from the company with your severance package being based on your current pay and if they do not like that then you can always take your grievances to a public outlet.
However, instead of searching your state's DoL website, try calling them and speaking to one of their labor specialists, the information is free and you don't have to worry about them trying to get you to bring them on as a lawyer. |

Nothing stops them from cutting your pay but it is an insult to you. I would start looking for another job even if it isn't as good as the one you were promoted to. When you resign give your reason as the pay cut you received for stepping up to the plate to cover for your dead colleague. Chances are they will withdraw the attempt to cut your pay.
Another option would be to tell them that you'll take your old job back at your old pay scale but be sure to make them understand that you will not accept any additional resposibilities or tasks. |
