Im 16 and want to become an Emancipated Minor? I need lawyer/attorney advice, IF NEEDED? etc.?
Heres my story. I got pregnant by my hubby of almost 3 years, yes i know please dont talk bad about me??? I had a missed misscarriage, and had to have a dnc at 10 weeks pregnant : ....(
Before i misscaried i was living with my hubby and his parents, Ive bought my own food and clothes for the past year and a half. and i lived with them about a year... Recenty my grandmother, whom is my guardian decided she wanted to retire and move to hawaii, but i stayed with my hubby because i didnt have the Miscarriage yet.... So then after i did miscarry, I was told by my grandmother/Legal guardian, that either someone had to take over the guardian ship or i had to get married, to stay with my hubby which is moreno valley ,ca ?
And obviously they didnt want to take on another big responsibility(my hubbys parents) and take my guardianship? so i ended up having to go to hawaii? its not fair i was suporting my self already, and doing great, and now everything is RUINED, and im misarable here? I really want to go to CALI, and get emancipated, i just payed for my own round ticket whick was 500 dollars to go visit my hubby for a month, hes not 18 for another month so?? Does anyone know of any attorneys or lawyer that can help me out in the riverside county area? CA? I babbysit and my hubby has a job and as soon as im done getting my g.e.d in a few months im going to start junior collage and get a job too?? Please i need advice??? thanks so much :(
sorry if im in a rush, and misspelling theres just so much drama and arguing here i cant take it, and i cant take how my grandmother treats me like an adult, and i buy my own clothes,etc. i might as well be living out of the house as well. THX :)

were engaged ever sence ive been pregnant. but now we dont want to rush into things, and want a nice wedding so we want to wait untill were both over age. and yes my parent agrees to it right now but we just dont really want to we want to have money,etc. so id rather get emancipated

I am lost here...you said hubby so I thought u were married, yet, u say u will get married when 18>>.what are u?anyway just because u buy your own clothes doesnt mean u are mature enough to get emacipaed. You have to support yourself, which covers paying rent, food, you must work FT and be able dot do all those things. I doubt u are mature or educated enough to make a decent wage. |

Because you live in Hawaii and your guardian lives there, emancipation has to take place there. Below is a link that gives you the info. Which states you must be 16, married, and have it signed off by a judge and guardian to be emancipated.
However you have a loop hole. Now the good news, you are in California and per the courts there, you can be emancipated.
How do I get emancipated?
There are 3 ways to get emancipated: (I only listed the one that applies to you.)
Get a declaration of emancipation from a judge. To get a declaration of emancipation, you have to prove ALL of these things:
You are at least 14 years old.
You don't want to live with your parents. Your parents don't mind if you move out.
You can handle your own money.
You have a legal way to make money.
Emancipation would be good for you.

Do you understand that the word "hubby" means "husband"? I ask because you talk as if you are not married to this boy, but you refer to him as your hubby, so your question basically makes no sense. If you're married to him, you *are* emancipated, as far as I understand the law. A wife does not also need a guardian.
But you're right -- what you really need to sort out this whole situation is advice from a real lawyer. Well, that, and a whole lot of common sense -- but you're not likely to find either here at Yahoo Answers. |
