The only requirement is that you were fired (didn't quit) and you did nothing to cause them to fire you, i.e., theft, misconduct, etc. |

Even if they state they had valid reasons for firing you, it comes down to whether you were performing your job to the best of your ability. If you were late alot or blatantly doing something wrong after having been warned previously for the same action then you probably won't win unemployment. But it never hurts to file and see what happens, especially in these times. If they fired you for something without proper documentation you have a good chance at winning. |

Hi--it would probably depend where you are & what the rules are. It would also probably depend on why you were fired. NO point in telling "us" the Yahoo community unless you also fill us in on WHERE You are (state or province & country).
Plus you should also cross reference whatever info you do get from on here. You have to remember you're talking to people who are all over the world--and our laws aren't the same.
I can tell you that in Canada & in Ontario, you have to be laid off or forced into leaving due to some unfair situation OR it was an "unjust" firing which can be from all sorts of reasons to be able to claim EI (OR UI)...same thing.
If you are in Canada--you need to go to the local HRDC office for assistance, you also need a record of employment that you should have received from your employers. If you don't have that--they have 30 days from the date that YOU were fired to provide you with one--it would be worth your time to not remind them about this.
If they don't provide it--they are at fault & have to pay you. BUT it's a double edged sword. If they can prove that they sent it to you (aka mail or courier) you can be have what EI you are elidgable held back.
Your best bet is to take your last paycheque to the EI office if IN Canada & apply. That office will have it on record that you applied from day 1 (or as soon as possible) & that the RoE (record of employement) wasn't received from the employer until day X...or if at all.

You can't get unemployment in general if you were fired or if you quit. Only if you were "laid off". If you were fired for some sort of unjust reason then you could try to fight for unemployment though and they might give it to you. Unemployment is based on your past year of wages so you would have to have had a job for about a year to get it. If you don't get it, try to sign up with a temp. agency and if they don't give you enough hours, then file for unemployment due to "lack of hours" ...which is essentially the same as being laid off and they will go against your previous employer then...fired or not. |

Unemployment is for people who have lost their job through no fault of their own unless it is for GROSS MISCONDUCT.
Why did they let you go?
If its for attendance or violation of a policy chances of your being eligible for the benefits are slim. The decision lies on the employment judge. |
