I am applying for a company that is asking have you ever been convicted of a felony or misdemeanor?
They are a pharmaceutical company and unfortunately they say they do a background check. I have a misdemeanor and I feel if I disclose this on the application it will automatically take me out of the running. What should I do?

You should disclose your misdemeanor it may not disqualify you. If you do not disclose it and it comes up in your background check you will definitely be disqualified for lying.

Be honest. Disclose the misdemeanor. Even if the initial background check does not show it, it may pop up later. It happens with my wife's company from time to time. When it does, the employee is ALWAYS fired. Often, if they had been honest initially, they would have still been hired. Getting fired for lying on your application for something like that makes them ineligible for unemployment in this state.

IF they run a background check they will find out.

It is best to disclose this with explaination.

'If you do not disclose it they will find out and you won't get the job.

Your only strategy is to be upfront with them, they will find out, it is best if it comes from you as then you can control the situation.

Disclose it. It WILL be found on the background and if you did not disclose it and they find it you will be out of the running that way too. They cannot legally consider your criminal record unless that crime has to do with their industry in particular. Say if you were convicted of forging a prescription, yes they would have a right to not hire you, but if your conviction has nothing to do with their industry or your previous employers they cannot use it as a deciding factor in hiring you.

you can either disclose it and hope for the best or you can say nothing and have them believe you are untrustworthy and not worth employing once they spend time and money checking it themselves, and trust me, it's not just words. they do check.

Always be honest. They would probably find it and would not hire you because you lied. Be honest about the misdemeanor and give an explanation. Good luck.
