I am applying for a good job at a large factory, when I fill out the application, am I required to tell them..

that I was injured 6 years ago while working in another factory? I hurt my hand and collected about $4500 from work comp. Do I HAVE to tell them that anywhere on this app? Or if I am asked, am I required by law to tell them about that? I'm afraid it would hurt my chances of getting the job.

No, you are not required to. And, being hurt on the job probably wasn't your fault to begin with.

It depends on state law, but generally it is illegal for any potential employer to question your health status or history.

If you are not now incapacitated in any way and the injury will not prevent you from doing the job, I would not volunteer the info. If asked, I would tell the truth by saying that you did get injured at a previous job, but that is no longer a factor.

You are only required to tell them if it is asked on the application or you are asked in an interview. Other than that, keep your mouth shut!

Federal, state, and local laws should be reviewed in advance so that unlawful preemployment inquiries are avoided, and, to the extent possible, questions should be designed to provide only the information that will be needed to determine an applicant's ability to perform the essential functions of the job in question.

Usually they can get that information on their own. WC courts keep a database that employers can access about the basics of any claim.

If there is a question that asks that, then yes, but if not, then no, you don't have to answer.

Typically companies ask that because they want to determine their risks if they were to hire you, but really, I think that is illegal. They are trying to prevent insurance fraud, but that decision should be up to the workers comp carrier, if they use a different one then your previous employer then they wouldn't know about the injury anyway.

I know certain subjects are illegal to be asked, and that might be one of them, look up the laws in your area!!


Just be careful and stop hurting yourself, lol.

OOPS, if they participate in Yahoo Answers-- you just let them know! Anyway, if it will effect your performance then inform them off the record , you will be penalized for a previous injury if something was to occur where you could have become hurt. It may effect your employment either way. Think twice!
