My supervisor has been a pain in the but since I got hired. I was hired as an independent contractor and work as a commission paid employee. He tells me that I have to work under eight hours because my employer doesn't pay over time. To me, that doesn't make any sense when I know that I am an independent contractor and I don't expect over time pay because of that.
Is he just being hard on me because I just started working and he wants to make a fool out of me. He says I have to clock right at the hour and clock out right at the hour. I have never heard of such, I thought employers wanted you to be at work 15 to 20 minutes early. With this new job it seems like they don't like you being early at all.

If he's telling you when to clock in and clock out and how to do the job, YOU ARE NOT AN INDEPENDENT CONTRACTOR.
There are specific rules.

Your employer is cheating you.
1. You will have to pay the ENTIRE social security tax yourself - the employer's AND employee's portion.
2. You are not covered by workers' comp insurance if you are hurt on the job.
3. You are not covered by unemployment comp.

Sounds like your supervisor is just trying to cover his *** legally. Some employers have been burned in the past for allowing their workers to work more than 8 hours a day, and not paying them overtime. When they get reported on, they have to pay a large fine and backpay. |
