I am currenly employed. I just got convicted for a federal felony offense (fraud conspiracy) with no jail time rather 2 years probabtion. Should I tell my employer? I have nothing on my record besides this.
What happens if I get a promotion? Will they do a background check? Some good advise would help.

Check your company's policy and procedure manual, and any employment contracts or applications you may have signed (you can ask your HR person to see your folder which would have these if you didn't keep copies). If you must you must.
Also, if you work for many Government Agencies (either directly or as a contractor) - such as DoD, DHS, SEC, etc., you are REQUIRED by law to disclose this - but to your SECURITY officer. Also if you hold any security clearance, well, since you are asking the question it is clear you don't.
You really don't want a "termination for cause" on top of the conviction.
This is something that will be very difficult to keep "private" for any period of time. Moreso depending on the restrictions (if any) that may be a part of your probabion. Keep that in mind. Really, it is likely that they (or someone) will find out. It is public record. |

Nature of the work will dictate if you need to inform them. securities and exchange type jobs you are required to inform your employer immediately or face additional legal troubles.
Assess your situation. If you are more then likely legally obligated to let them know, you best do it. if not, and the case is kept quite and out of the papers, *unlikely, but possible with arrangements and plea agreements* I suggest you keep it as quite as possible, but realize it could later be used as blackmail against you by a subordinate if you become a supervisor. |

I wouldn't think they would do a background check with a promotion. I say keep your mouth shut if you want to keep that job, because another one might be hard to come by now that you have a record. Even if a new employer doesn't do a background check, the application will ask if you have a conviction. |

From my experience I"d have to say that it all depends on what kind of job it is ifrst off.
Fraud is a pretty tough charge to put on applications and expect success, well unless your going to work at a telemarketing office. (ha-ha)
No, but really my current boss loves the fact that he is molding a convicted felon/ex-drug addict/theif/suicidal ************. Yeah that's me. Well it used to be me, now i have been working for this private dry cleaner for 5 yrs I got married just after I started working there I got my lisence back after 12 yrs of not driving because of a 5 yr revocation and then just not having the $ to pay fines to regain my driving privelages. Well you get the idea ( sometimes it matters & sometimes it does'nt ). Just wiegh out the options and make a decision. Personally I would'nt tell anyone and go for the GOLD.
Stay outa trouble man, it's not worth it. I'm sure you have people who are hurt to see you going down the wrong path and if your an extremist like me it won't be ending until your faced with death. |

I woukdn't say anything unless you originally signed some sort of agreement that you would divulge this type of information.
If a backround check is a condition of promotion, maybe bring it up at that time. |

It's not routine in business to run a background check simply for a promotion unless your promotion would require a security clearance i.e. Governmental work.
I'd sure hang onto that job though because it is far more common to have a background check done as a new hire.
You sounded a little afraid. Try not to be. We all make mistakes, some just get caught. |
