I am getting written up because I got injured outside of work. Is this right?
Find answers to your legal question.

I am getting written up because I got injured outside of work. Is this right?

I am being written up at work for injuring myself in a kickboxing match outside of work and calling in. Is this fair and should I refuse to sign it? I know of some co-workers who no show and never get written up or fired.

it sounds like you're getting written up because you called in, not because you got injured. you haven't really given enough information for us to be able to tell if the situation is "fair" or not. your company could have a policy about how much notice you give when calling in sick, or if you can call in without penalty when you dont have any sick days left, etc. either check your employee handbook, or ask your human resources department. don't compare your situation to situations that your co-workers have had. you dont really know their full situation, and it'll just piss off your HR dept.

Innocent until PROVEN Guilty
How many unexcused absences do you have, are you following the company attendance policy?
We are allowed 5 in a rolling calendar year. So if #6 comes and it's because we got hurt, our cat died, we're sick, hungover etc, it doesn't matter. We get disciplinary action.

It doesn't matter if you sign it or not, your signature is not saying you agree or disagree just that you had the conversation and you know what the disciplinary action is.

Also, if you are an "At will state"...they have the right to even let you go, just like you have the right to go.
Read the policy, follow the policy, find out if you are in an at will state and if you are wrong, clean up your act.

Are they writing you up for being injured, or for not being at work or not being able to work? It's not THEIR fault you were injured.

Whether you sign it or not doesn't really matter. It is still fact, and will still go in your file.

Just like the professional athletes who lie about off field injuries, you are being written up for a breach of contract. Both their written contracts and your verbal agreement are covered under the "Performance and Compensation" clause.

Basically, you agreed to do a job and they concurred, on the next pay day, by paying you for doing it. The next day you tacitly extended these same terms and they confirmed it by paying you again. For the overwhelming majority of employees in the United States, this is what defines an "at will" environment.

Any of these employees who fail to report, regardless of the reason, have violated the performance clause. The company then considers if the excuse is valid enough to excuse the absence and conditionally extend the contract, despite non-performance. The first step in reporting to work is being "able" to report and self destructive behavior, even if you win the match, does little to demonstrate your understanding of this requisite.

In not terminating you, the write up is their way of saying it would be better to watch reality television than to participate in it. Good Luck.

They are writing you up because you did not show up to work. It is your fault you were injured. Refusing to sign gives them the legal right to fire you on the spot.
