I am losing a lot of accrued vacation that has to be used but we're to short staffed to get time off. Legal?

I am looking to find Alaska's Labor Code regarding vacation time, so please bear with me.

I have been unable to find any Alaskan state law that deals with vacation pay (other than to say it is included in the computation of wages for the purposes of unemployment compensation).

Check with your employer to see if you can cash it in for wages (if they are unwilling to let you have the time off).

if you are due vacation time you should be allowed to take it or get compensated nicely for it ... talk to someone ..if they did not let you take time off thats not right and i would say something...

I know your not in an union situation, because we wouldn't be talking about this..Unless you use it you WILL lose it.. Without a union contract,, companies consider vacations a benefit which can be withdrawn, or eliminated if they choose to do so.. Its like a wage cut, ending sick days, even holidays.. I spent 17years in organized labor (union shops) and 20years in a non-union atmosphere!! Very different to be sure.. One little trick I learned in a work place just like yours,,If you get sick for about a week, your company will be more than glad to use up your vacation allowance,for your illness.. Then you'll be caught up.. Just a bad cold, with diarrhea will do nicely,or you could have slipped in the tub, and threw your back out. Or whatever you think will work in your situation.. If you wait till the new company is in, you definitely will lose out.. Its a shame what has been taking from the American worker, but believe me, if business has its way, they will take any and all benefits and wages from the American worker!! To be fair to you, they should compensate you in some way, either letting you take the time off or paying you for it.

But you didn't ask if it was fair, you knew that answer, you asked if it was legal. Vacation time isn't mandated by law, so it most likely is legal.

I don't know about Alaska law, but in California, vacation is considered pay, and cannot be taken away once it is earned, any more than a company could tell you to give back some dollars from your paycheck after you've earned it.

It's possible you have a case, since the company required you to work, and deprived you of the possibility of taking your vacation. If they gave you a long warning, and you didn't burn the vacation all year, then your case would be weakened. Also, since this happened to others, a class action might be possible. This is the kind of thing that lawyers like to take on, you might want to check with one to see if you have a chance.

company policy dictates how much vacation you can carry forward, there is no law that addresses this
