I am out of a job and can't find one, and I think i was wrongfully fired?
Find answers to your legal question.

I am out of a job and can't find one, and I think i was wrongfully fired?

I am a restaurant manager with a little experience, I was always a chef. I was fired last Saturday, and was told it was cause of probabtion, but the night before, I broke my toe, I still worked, but I went to the doctor afterwards and then called my boss after to let her know I can work. The next day, she lets me go, should I try to Sue her and the company. Also, I can't find a job, and my wife is pregnant, i feel like my life is over

I work in the restaurant business too and believe I was wrongfully fired. You can try to get unemployment, hopefully it works for you it didn;t for me. I'm also trying to find another job it's been over a month. I don't feel like my life is over but am going thru very hard times like rock bottom hard times and people are telling me to think positive but it's so hard with this economy. Good luck

Depending upon the state, if you were within your probation period, the employer can let you go for ANY legal reason. That matches your equal right to resign for any reason.

Your life isn't over. You're just out of a job right now. If you have restaurant experience and are willing to work and have a drug free and crime free background, you should be able to find a job in a matter of hours.

Going to court isn't the answer. Going aggressively after finding a good job is!

Did you fill out a job accident report before you left work? If you did you have legal recourse. If you didn't you will have to prove you broke your toe at work which will be extremely difficult without an incident report.

Legally they can fire you if they don't like the way your hair is styled, really, no kidding. My mother in law is an employer and she found this out because she wanted to get rid of someone without being sued. They can even fire you if they don't like your clothes. I think it's very harsh and I don't like it at all but what can you do. You must feel terrible, but you can't sue and it wouldn't be worth your time and lawyers fees. You can always go above your bosses head, she can't be the absolute final answer! Good luck and pray alot!

Congratulations, u like most multimillionaires were fired.
they just didn't let it stop them.
will u?

OK u can't find a job in ur field, so get some thing to put cash on the table .

contact local/state employment agency to see ur legal options. go to more applications. find work that pays .

as for suing , u'll spend more money time and emotional effort than u can afford fro a lousy return .

suggest
acquiring reading rereading take notes of
'48 days to work u love' d.miller
'what colour is ur parachute'
'total money make over' d.ramsey

the books will give u insite into what u like and may be best at , also ways to pay for such. also a better view on interviews job hunting.

note a 'job' u love becomes a vocation not a 'JOB' and u'll earn more $$.
the other book will assist u in keeping ur money and not becoming a slave to debt.

mandatory reading for our associates world wide.

no one plans to fail , they just fail to plan.

remember it hurts now, but not in the long term unless u let it.

If you were still on a probation period then I think it is legal for them to fire you if you did not perform your job to their expectations. Check with the local labour board or a lawyer to see if it was wrongful termination.

It depends, Did you break your toe at work?
If you did you could probably get workers comp.
Talk to a lawyer, You wont have to pay any money up front unless your case is won.

Merry Christmas and good luck, It's not the end of the world.
Hang in there dude.

Move on and get a better job. This week will be tough but right after new years you can get out there and get a job. Don't wait for an ad in the newspaper or the unemployment people just start knocking on doors of places you want to work. You will find an open door at one of those places. As of midnight December 31 your full time job will be looking for a job that you want and you can keep. You will be successful doing this if you just keep trying. A famous person( can't remember who) said the only difference between a successful person and a failure is that the successful person tried one more time than the failure. Ben Franklin didn't succeed on his first try and neither have any of the other successful people in the world. Look at Donald Trump. How many times has he been broke?
