I am right to take this further....?

during the week I was asked to help out at work and stay on for a few hours longer than my normal shift (overtime) by my manager.
A few days later I was told that I wouldn't be paid for the extra hours because there is an 'overtime' ban on the company. Now I don't work for the benefit of my health and I could do with extra money... should I take this further....
i.e. have a word with tha manager or talk to head office?
Thanks for any help. Additional Details Yes it is a large company, a high street shop

If your manager asks you to work extra hours there is an implicit agreement that you will either be paid for those hours, or you will be given time off in lieu.
An overtime ban is not your problem. Your manager should have thought about that before he asked you to work. Definitely take it up with your manager or someone else senior. However, be prepared to compromise and take time off in lieu rather than insisting on being paid for the extra hours.
The exception to this is if you are in a "salaried" position, where it is normal that you work as many hours as needed to complete the job for your fixed monthly salary. |

You need to check your contract!!
Many contracts will have a clause mentioning "Expected additional overtime" which is to be included in your salary.
If it's not there, then they shouldn't have asked without some form of compensation in place.
You are within your rights to ask for time in lieu! So if you worked an additional 3 hours, you could clock out early at the end of a regular shift.
This has to be in aggreement with your manager though!!
It's the best solution to this one, as the company won't pay you, and he/she doesn't need to clear it with anyone!! |

I don't know where you are, but over here in the USA an employer is required by law to pay you for all hours worked. They are also required to pay overtime for all hours over 40 unless you are salaried, hourly but classed as an exempt employee under DOL, or signed a contract with a "...plus all other hours as required..." clause (might be worded differently in your contract).
If you signed an employment contract, check it first for the clause mentioned above. If you see that clause there won't be much you can do as far as the law is concerned.
If there's no contract definitely take it further. Talk to your manager first and then go higher if you don't get results. In the working world it is never wise to go over the boss' head without discussing the matter with him/her first. |

I would say that if you asked your manager beforehand "Will I get paid for staying later than usual?" and the boss said yes, then take it further. Although it will just be your word against his. If you did not ask and he hasn't paid you, he may just see that you've done him a favour |

Yes,! speak to the manager and voice your concerns and ask him why he didn't tell you that you wouldn't be paid for the overtime when he asked you--firms that want workers to work overtime for nonpayment must be in financial trouble and wont last long in business |

Yes, you were ASKED to stay back and work the overtime. If they dont allow you to work overtime, then that is known NOW but not before. You should at least be given time in leui for you additional hours worked. Do take it further. |

def take it further, if you were asked to work extra and was not gonna get paid, your manager should have made it clear, if he said you were gonna get paid overtime, then i would def take it to head office |

It's standard practice in retail.
If you work for a high street retailer then more than likely there is nothing you can do about it.
If you read your contract carefully it will probably state something like 'your contracted hours are xx per week and you will be expected to be able to meet the additional needs of the business during peak trading periods.'
It won't be exactly like that, but similar.
Basically in retail most people have to work part of it free. Most shops you have to get in by 8.30am, but you don't start getting paid until 9am, same goes with closing up. If you close at 5.30pm you'll probably leave about 5.45pm but you don't get paid for that.
It all depends if your manager actually said he would PAY you for the extra hours.
If he just asked you to stay on and he didn't mention pay then you'll get nothing.
It's Christmas and January and these are peak times for retail, so you aren't going to be the only one who's had to work a few extra hours.
Edit_________
It's no good thumbing me down!
All the big retailers do it... M&S, Tesco, BHS, Boots.
If it was illegal they wouldn't get away with it! |
