I cant get my wages as i dont have a bank account?

My employer is refusing to pay my wages into my wifes bank account i cant get an account open and i now have money sitting in limbo also for the past 2 weeks they have not gave me my wage slips.... does anyone know where i stand and if it is as they say that is now illegal to pay into an account that is not in their name ?

They must pay you, its against the law to NOT pay you.

They need to "Cut" you a manual check for the payroll account of their company and put it into your name.

You can go to their company bank, and cash it with the proper ID and a small fee at the counter.

Most employers will not deposit any funds into an account that doesn't bear your name on the record. that is good business practice. That is industry practice for decades.

A savings account takes a little as $25-50 to open, contact a few banks and find out the details. You need an account in your own name. or You will have to cash your payroll checks at the "check cashing places" and loose 2-10% of it in charges for that privelege.

You don't have to do direct deposit - the company can write you a regular check that you can deposit into any account you wish.

If your name is on your wife's bank account then they should just direct deposit it into there. I think they would be correct in saying that they cannot put the money into her account unless you have a joint account with both your names on the checks, etc.

I never heard of an employer holding wages because someone doesn't have a bank account. That sounds shady to me. We hav people here that don't have their checks directly deposited and they just get a check. One girl here has no bank accounts. She cashes her check at a grocery store.

Hey people, read first then answer. The kid said he cannot get a bank account and his employer will not write him a check without a bank account.

When you were offered the job you would have been told the method of payment so the company are within rights to hold money till you give them a bank account to pay into
Is there some reason why you don't have a bank account or at least a joint account ??
I suggest you open an account as soon as possible , most high street banks are offering incentives to new accounts . HBOS are offering £100 to new accounts so long as salary is paid in monthly.

If you have a written contract, check if it specified a method of payment. If it specified payment directly to a bank account you will have to open a bank account, otherwise you are entitled to request payment by cheque or cash. Regardless of the bank account issue, they are not entitled to withold pay slips. A word of caution - some dodgy employers do not issue pay slips as they are not actually making statutory deductions on your behalf such as tax and social insurance.

You can get a pre paid credit card and get it paid onto that. That involves no credit check. Or you can get the to write you a cheque and then cash it at a money shop, but there is a small fee.

surely if you give them written consent that you want your wages to go in your wife's account then it shouldn't be a problem, or yes alternatively insist they pay you by cheque.

either way, if you are working then you are entitled to be paid. there is no reason for them to withold payment. it's up to you where you want your money to go!

is this a small company by any chance??

you could do it a couple different ways....

you could go to the DMV and get a photo ID. this isnt a drivers license, just a photo ID.

you could take your paycheck, endorse the back and write "for deposit only". then your wife could deposit it into her bank account and give you the cash.

third option would be to take the paycheck to a check cashing place. they charge a fee, but it would be worth it in your case.

They should have an option for people who don't have bank accounts. Weird.

What you can do is open a joint account in your name and in your wife's name. Then, as soon as your check gets deposited, transfer the funds from your joint account into her account. :) That way, if you are trying to avoid someone getting their hands on any money you have in the bank, you will not have any on your account and they can't touch her account.

If they are saying it is now illegal, this could be due to the money laundering act and they have to abide by that or face a heavy fine. Whatever your financial status, you CAN open a basic post office account as I managed to when I was made bankrupt and needed my benefit paid into it. Some banks also offer basic accounts where certain limitations are imposed, Lloyds TSB definately do them. Go to the Post Office or Bank first thing tomorrow and open an account, take two forms of ID with your name on it, pref a passport, driving licence and a utility bill, mortgage form or property deed or tenancy agreement. If you do not have these, there may be a way round it, the Post Office can tell you. If your wife has all the bills in her name, she can easily add you to them, I just added my boyfriend to my gas bill as he needed ID. Tell your company that you are doing this and will let them know as soon as you have bank account details.

As a follow-up to Denise W's answer, your company cannot force you to accept your check via direct deposit. If they are refusing to issue you a physical check, you can contact your state's labor board to report them.

In the last year, the law CHANGED the federal definition of payment by "money" which now includes electronic payment.

Therefore, an employer CAN require that an employe be paid via direct deposit. HOWEVER, although I'm not looking the law up right now, I believe the employer is required to provide an alternative form of electronic payment, i.e. a debit card for an employee to be able to go to an ATM and withdraw funds. Only problem with that scenario is that we all know ATM's don't pay out $456.32, and that you could cash that out and only be able to withdraw $450.00 of that money.

It's been a while since I looked at it, but again, I don't believe the employer can do one without the other, because time worked is time PAID and there are VERY strict employment in laws in most states regarding timliness of payment.

As many people on these boards ask if they have a case, I find it interesting that you are not - and you genuinely just want your money.

This is one that you should probably contact your state department of labor or possibly the federal department of labor (www.dol.gov), because THE EMPLOYER CAN BE FINED for each day of non-payment of your wages.

If they are stupid enough to do this to you though, be careful that they are probably stupid enough to "coincidentally" fire you for another reason after, which ironically, would be another little lawsuit potential for you... retaliation...

My suggestion would be to go to the HR department and discuss the ATM/debit card option and if they don't have an answer for you - then go to DOL, but I would also be looking for another job, just in case... since you obviously need the money more than a lawsuit (as most of us do!).

They can't refuse to pay you .. they can cut you a check and you should still be able to cash it at the bank or check cashin location.. in either case a nominal feee will apply.. BUT they cannot cut you a check into someone elses name. Have them pay you and sign the check over to your wife ..she can deposit it then you're paid..may be a few days

Could your wife add your name onto her account at the bank? If she made her account a joint account with you, then they shouldn't have a problem depositing it. Or, just demand that they give you a check. You'll need to cash it at the bank that the business uses.

I was able to have my husband's check deposited into my account and my name was the only name on it. He worked for a major national company. But not all companies will do that. However, if you request a check rather than a direct deposit they have to cut you a check (if you're in the US -- not sure about other countries). No company can force direct deposit.

Of course adding your name to your wife's account is not a bad idea. She probably just needs to bring home a signature card since she has already given her ID as the primary account-holder.

Your employer can probably help you open an account at their bank, but if you don't want to, I don't think they can force you to have direct deposit and they must pay you.

You could contact the Department of Labor and make a fuss about it, but why not just go to your personnel office and explain your problem (whatever it is). I'm sure they will try to accomodate. (and if they don't - find another employer and THEN file a complaint with DOL).

you don't need photo id to open an account you only need 2 forms of id, electric bill phone bill etc, my friend gets his wages paid into his wife's account as he previously had financial problems.

i don't believe an employer can pay you in someone elses names. however (not sure where you're located) even if you don't have a bank account, you should be able to cash your paycheck at any local bank. some charge others don't. hope this helps you out a little bit

Well it is illegal for them to put money into an account that does not have your name in it. If you had a joint account, it would be allowed. They should be allowed to give you a check though. I don't understand why they don't do that at least.

lots of banks wouldn't let you do this even if you are married. the only way is if u have joint account. however, believe it's illegal to not hand out check stubs, or not getting paid b/c of no bank account for that matter. i have to say i totally agree with morgana. it does sound shady and you all both need to contact someone to see about this problem. (maybe contact an employment office or some place?)
