I got fired for fighting. I want even at work. I was off that day and next door at Denny's. I hit a guy with my keys in my hand and got fired. Should I sue?

First, you would have to have a seriously strong case for a wrongful termination case if you want lawyer to take this on contingency. Because as a restaurant employee, your former employer could argue that you were in some way predisposed to aggression and violence, you presented a possible threat to customers and the public.
Fighting is not a protected class, such as age or gender, so you have no resort there either. That rules out an investigation by the EEOC.
I would put it behind you and move on. It may have been wrong, but unlikely that it was illegal. |

Most of the US works on an "at will" employment system which means you can be fired for any reason (or even for no reason), with the exception of protected categories such as discrimination due to race, creed, color, etc. So, you can sue, but will most likely lose.
In addition, check the employee handbook, you will probably find you signed an "at will" clause by acknowledging receipt of the handbook. |
