I got fired for looking for another job is that illegal?

i got fired for looking for another job my boss aked me if i was looking for another job and i told him yes and he just told me when i clock out thats all he needed me for thank for working for him and he told me that if im gonna be looking for another job that he needs too save his a** and thats all he told me. i think thats unfair dismisal. what legal actions can i take?

that is completely legal. an employer can fire you for any reason, including the boss not liking you. isn't capitalism great???

Almost all state are "at will" employment states which means either the employer or employee can terminate employment for any reason. In order for it to be an wrongful termination it would have to be for an illegal reason, meaning discrimination or maybe in your case if the employer violated their own discharge policy. If they do not have a discharge or termination policy there is nothing you can do, if they do have one you need to be able to prove they didn't follow their policy, but all that would come about is you getting your job back. To do that you will need an attorney which is costly and probably not worth it. While this seems unfair, there isn't much if anything you can do about this.

It depends on your state. I know here in Virginia, the laws state an employer can fire you for no reason, they also state here that you can quit with no reason. Look it up on your State Labor Board. It should say on there.

Unless you have a contract or a union, you can be fired for any reason when ever the boss feels like it

Very true buddy. That is unfair dismissal. I am here in nz rite now. Dont know wats the law in your country. But the thing is very recently one nurse in Hospital was dismissed unjustifiably and she approached the employment relations department in nz. She got $16000 (9662 for lost wages and 6000 for hurt feeling) from the company who dismissed her and got the job back as well. She was dismissed because in a meeting with regional manger she had raised questions about serious nature and was dismissed.

This provides implication that that u have been dismissed unjustifiably and i will advice you to approach the employment relations committee or department in your country and notify them of this incident and they should be able to provide you with justice. C ya have a good day !

It depends. Are you using company time to look for a new job?

Many states, a company can dismiss you at will unless you have a contract.

However, I would request to the employer why you are getting fired in writing. If this is the only reason he is firing you, you most likely will be eligible for unemployment pay if you worked for him long enough.

If you really needed that job, I would confront the boss and let him know that you were job searching for a 2nd job to work at night because you are trying to feed my family, hold on to my house, pay the rent, etc.( fill in the blank). Maybe he would understand maybe not.

He legally had no right to do that, and depending on what state you live in you could take him to court, you could fight it because he had no reason for firing you..but thats only if you think its worth it..lawyers are expensive..but you could go to a lawyer and ask him if you would get anything out of it..

I don't know how legalthat is or anything but that is very unfortunate and I don't believe it is grounds for dismissal. I would definitely try to do something I am just not sure what all you can do.
