they can say anything they want as long as it is the truth, if you pissed them off bad enough. Can they tell your employer sure they can, is it legal yes it is because they are not lying, is it unprofessional yes it is. Can you do anything about it , no. Be happy you were not arrested. |

If it is illegal for them to give a bad reference I sure they can't go around sabotaging your future employment. |

If they tell your other employer, they need solid proof or you can sue for liable. If they had proof of a crime that was committed and did not notify the police, the people who had this proof may have broken a law, depending on where you live. In Canada and the USA, and probably many other countries, employers have to be very careful about what they say to other companies. Every company I have worked for had strict rules about what we could say about employees, and their training stressed the potential consequences of saying anything outside of what was on the list. It sound like you worked for a small company where the employed do not know the laws. Tell them that, if they tell your other employer, you will sue. If they do tell, talk to a lawyer. Many lawyers do not charge for a brief meeting to see if you have grounds for a law suit. Ask about this when you book the appointment. |

legally no. they're only supposed to tell them your hire date, and start date. many companies still however divulge more but they're not suposed to. the best thing for you to do is not put them down on anymore job applications.be smart dont put them down. putting them down you;ll never get hired anywhere. for the gap in your employment if asked just say you were ill, you were taking care of an ill relative, volunteer work, anything else. also if you werent arrested and put in jail its not on your record. they're just scaring you. also you made a mistake by stealing but dont beat yourself up and dont let anybody else. you made a mistake and you;re not perfect. let it go. |
